Recent years,the rapid development of the social economy has brought about the rise of emerging industries such as the Internet,self-media and e-commerce.This is due to the high degree of flexibility required for workers in such industries.Compared with the standard working hour system of 8 hours per day and no more than 44 hours per week,irregular working hours as a flexible working method,which is not limited by fixed working hours and workplaces,is more suitable for the needs of the current labor market.However,the application of the irregular working hour system has not only greatly improved production efficiency,but also caused many labor infringement problems.On the other hand,the legislation on irregular working hours in China’s legal system is relatively old,and most of them are reflected in local normative documents with low levels of effectiveness,so that the problems arising from the application of the irregular working hours system are difficult to solve.Taking the development process,influence and current situation of application of the irregular working hour system as the starting point,this paper summarizes the problems arising in the application of the irregular working system through the analysis of labor infringement cases under the irregular working time system.On this basis,the institutional shortcomings of the irregular working hour system are pointed out.Finally,targeted suggestions were put forward in five aspects: legislation,administrative examination and approval,labor inspection,collective bargaining,and overtime remuneration payment standards.
