In the new era,China's economic development has entered a stage of transformation and upgrading,reform has entered a period of tough times,the economic structure has been adjusted,a series of new industries have emerged one after another,the division of labor between different industries and types of work has become more and more refined,and flexibility and new trends in the development of working hours.With the economic and social reforms and upgrades,a series of disputes have inevitably occurred in the labor field.There are many legal problems in the working hours of workers.Many working hours problems make workers expect to be alleviated through the legal system.However,working hours system has been established for about 25 years,during which almost no changes have been made.It seems that the settlement of these working hours disputes is somewhat left-handed.This article mainly discusses the legal problems existing in the working hours of laborers in our country,and then proposes solutions from legislation,labor security and other aspects.There are many legal problems with working hours in our country.The more prominent legal problems are the legal concept of working hours,recognition standards,and scope of application are relatively unclear in legislation;Phenomenon that has not been incorporated;employers wantonly extend working hours,seriously affecting workers' right to rest.In order to protect workers' rest and rest rights,labor remuneration and other follow-up rights,reduce conflicts between employers and employees,and ease social conflicts,this article discusses from the perspective of legislation,labor security and other levels.In terms of legislation,clarify the legal concept and scope of working hours,integrate the existing working hours norms,draw on foreign offline rights systems,and formulate clear and specific labor quota benchmarks.In terms of labor security,the labor security supervision mechanism,labor union security role and evidence system should be improved.At other levels,build a good competition mechanism and change the concept of labor.
