| Due to the wide application of mobile terminals,a large number of sports IP has been produced.On the one hand,it meets the audience’s demand for watching sports competitions,and on the other hand,it also provides a wide market for the development of domestic sports event video websites,and thus promotes the development of social economy.However,the endless incidents of Internet piracy,coupled with the lag of legislative protection and the lack of judicial protection,seriously restrict the healthy development of the sports events broadcast industry in China,and the infringement incidents of sports events need to be solved urgently.In view of this,this paper plans to carry out in-depth analysis and discussion of the above infringement problems,in order to promote the formation of a complete copyright protection system of live sports events,and then form a clean and positive environment of sports live sports events.In addition to the introduction and conclusion,this paper roughly contains the following contents: First,it analyzes the production process and characteristics of live programs of sports events,and compares with the originality and fixation of the works and other attributes of the works,drawing the conclusion that live programs of sports events should be defined into works.Then,through the negation of "video products" and the affirmation of "audio-visual works",it is proposed that the live broadcast programs of sports events should be included in the corresponding categories of works in the new Copyright Law and be protected.Second,illustrates the present situation of sports live copyright protection and dilemma,through the lack of legislative level,judicial protection chaos,summarizes the reality of sports live copyright protection,mainly is the legal attribute of the program is not clear and legal protection path is not unified.Third,to explore and put forward relatively perfect copyright protection suggestions from the four aspects of legislative system construction,judicial guidance,industry autonomy and the promotion of social participation.It is mainly suggested to revise the Regulations for the Implementation of Copyright Law to include the live programs of live sports events into the scope of audio-visual works;further distinguish the boundary between the right of information network communication and the right of government,industry association,Internet platform,and copyright awareness,and strengthen the copyright protection of live sports events in an all-round and multi-angle way. |
