As a powerful weapon for supervisory organs to carry out anti-corruption under the rule of law,the efficient operation of supervisory suggestions plays an important role in promoting reform and governance by cases in the units where the objects of supervision belong.However,there are still some problems that affect the standard operation of supervisory suggestions.The standardized operation of supervisory suggestions generally includes two steps:the preparation and issuance of supervisory proposals and the implementation of supervisory proposals.Therefore,the paper focuses on the analysis of how to produce and issue a high-quality supervisory proposal and how to obtain high-quality implementation of the high-quality supervisory proposals,and takes the current situation of the problems,the analysis of the causes of the problems,the analysis of legal regulations and the countermeasures as the logic.The problems,reasons and improvement measures of supervision suggestions in the process of standardized operation are discussed in chapters.This paper takes the website of the National Supervisory Commission,some websites of the provincial National Supervisory Commission and the website of China Discipline Inspection and Supervision Newspaper as the information source for searching practice cases,searches the cases with the title of "supervision suggestions" in the website,and analyzes the operation of the supervision and suggestion system in practice.Through the analysis of the above cases of supervision suggestions in practice,it can be concluded that there are two major problems in the operation system of supervision suggestions:the quality of supervision suggestions is not high and the implementation of supervision suggestions is not in place.There are the following problems in the quality of supervision suggestions:insufficient analysis of the cause of supervision suggestions,insufficient pertinence of supervision suggestions,non-standard format of supervision suggestions,and non-standard formulation procedure of supervision suggestions.There are the following problems in the implementation of supervision suggestions:insufficient use of supervision suggestions,insufficient tracking implementation of supervision suggestions,imperfect objection procedure of supervision suggestions,insufficient relief measures of supervision suggestions and alienation risk in the application of supervision suggestions.The problems in the operation system of supervision and recommendation in practice are mainly caused by the following reasons:the concept of supervision and recommendation is not fully understood,the function of supervision and recommendation is not clearly defined,the nature of supervision and recommendation is not accurately defined,and the process of making and issuing supervision and recommendation is not perfect.Supervision and implementation mechanism is not sound,lack of communication with the proposed units,lack of return visit assessment.In view of the above problems,this paper sorts out the existing legal norms of supervision suggestions in China,and clarifies the laws and regulations related to supervision suggestions on this basis,so as to provide theoretical bedding for the subsequent research.The improvement of supervisory recommendation operation system The improvement measures in how to produce and send a high-quality supervisory recommendation include:first,improve the pertinence of the content of supervisory recommendations.In-depth analysis of the institutional causes of corruption in the suggested units can not only communicate well with the suggested units,but also draw on the strength of experts,scholars and other consulting institutions.Second,standardize the external format requirements of monitoring recommendations.A more standardized and rigorous form of documentation can enhance the power of authority to monitor the operation of recommendations.Third,standardize the procedures for formulating supervisory recommendations.Starting from the proposal,approval and delivery of supervision suggestions,the boundary between powers and responsibilities should be clarified,and the division of labor should be standardized in the operation of the system.The following aspects should be improved in terms of how to obtain high-quality supervision recommendations:First,strengthen the supervision of the implementation of supervision recommendations by improving the tracking,feedback evaluation and assessment mechanism.Second,improve the objection procedure system of the suggested unit.The proposed units are allowed to express objections to unreasonable and illegal supervision proposals under the circumstances of legally justified reasons.Third,we should improve the relief mechanism and protect the legitimate rights and interests of persons to be dealt with.
