The Practice,Dilemma And Development Of Electronic Monitoring Application In Community Correction In China

The promulgation and implementation of community Correction Law of the People’s Republic of China broke the embarrassing situation of "no law to follow" in China’s community correction work,laid a solid foundation for the sustainable development of correction work,established the direction,and marked that China’s community correction work has entered a new stage.In the era of big data,the application of electronic monitoring in community correction should be further improved,and the construction of scientific,intelligent and information-based community correction should be promoted.Firstly,this paper studies the development and evolution of electronic monitoring system.By reading a lot of literature,it sorts out the concept and origin of electronic monitoring outside China,the theoretical basis of electronic monitoring,main technical forms and specific applications in criminal justice practice outside China.Based on data searching and field research,the application of electronic monitoring in the field of community correction in China is introduced,including the development history and main technical forms of electronic monitoring in China,as well as the changes brought by the promulgating of community Correction Law for the application of electronic monitoring in China.Focusing on the practical difficulties of electronic monitoring system in community correction in China,this paper finds that there is a conflict between traditional punishment concept and current electronic monitoring system,the legal regulation of electronic monitoring is too simple,the supervision strength of electronic monitoring has not diversified and the use of electronic monitoring information is insufficient.Finally in order to perfect the system of the electronic monitoring applications on the community correction in our country,put forward a conceptual change in further promoting the public punishment,perfecting the legislation of community correction in the regulation of electronic monitoring,establish a multi-dimensional multi-level electronic monitoring system,deepen the “smart community-corrections” and set up big data forecast model that four Suggestions,In order to promote the perfection of community correction system through the mature application of electronic monitoring.
