A Comparative Study On The Role Of Urban Communities In Community Corrections

Community correction is the product of the organic combination of government and social forces.From the perspective of social transformation theory,China is in a "transition period" from a traditional society to a modern society.Community construction and governance in various regions will inevitably show differentiated characteristics.Among them,N,W,and C cities are the east,middle,and The representative cities in the west have differences in the degree of community governance development and community correction work mechanisms.The main influencing factors are different types of community governance.Therefore,the author introduces governance theory,using the expansion status of community governance entities and the internal collaboration methods of community governance entities as two variables to establish a two-dimensional comparison framework,and judging the basic types of community governance in the three cities through the differences between the three urban communities’ role in community correction.It is the early stage of mixed community,the middle stage of mixed community and the late stage of mixed community.Three different types of communities have different roles in community correction,but there are general problems.According to the interpretation of the spirit and specific provisions of the "Community Correction Law",the author believes that the ideal type of community governance for community correction operation is autonomous community governance,that is,multi-participants participate in community correction on an equal basis under the leadership of the community.However,there is a big gap between the actual operation of community corrections in China and the governance of autonomous communities.First,the governance body is limited,and the community correction space is insufficient due to the role of social forces.The second is the administrative cooperation of the main body,which is difficult to reflect the role of the community.The above problems can be summarized as the lack of symbiosis between urban communities and community corrections.To solve this problem,we must first explore the root cause of the problem.The author believes that it can be explained from the "structural dilemma" and "essential dilemma" of community governance.The former refers to the social structure of the community,such as the external legal environment and the state of community construction.Limitations affect the development of community corrections,which is the main reason for the limited main body of community corrections governance;the latter refers to the low governance and unclear subject rights and inevitability of community governance that emphasizes the participation of multiple parties and equal cooperation.This is the community corrections administration The main reason for strongcolor.Therefore,to solve the above problems,it is necessary to proceed from the dual perspectives of adjusting the external structure and improving the rule of law in urban community governance.Starting from the adjustment of the external structure,we must first implement the "Community Correction Law" to adjust the environment of the rule of law to strengthen the connection between the community and community correction;second,we must increase the community’s investment in community correction by improving the ability of community resources integration.Starting from improving community governance,we must first form a community’s common will by establishing community culture and community management ethics;secondly,we must strengthen community organization strength and independence by cultivating community organizations to provide a basis for correcting the division of authority and responsibility of subjects.In summary,although with the implementation of the "Community Correction Law",there have been new breakthroughs in the system of community correction work in China,but there is still a large gap between the practice of urban community correction and legislation,and it needs to be further improved in accordance with the spirit of legislation and the actual situation of correction.Relevant norms are to implement the "Community Correction Law",and the state of community governance should be further improved to provide a more ideal community basis for community correction.
