Issues Of Ship Cyber Risks Insurance

With the development of network technology,the degree of ship system networking is constantly improving.Network technology brings convenience to the shipping industry,but also introduces cyber risks.The complexity of the causes of cyber risks and the diversity of responsibility make the international community pay more and more attention to the impact of cyber risks on the shipping industry.Although network security technology is constantly improving,it can reduce cyber risks,it can not completely avoid cyber risks.Insurance,as an important means of transferring risks,can provide necessary protection for shipowners.cyber risks is a new type of risk,which will have a complex impact on insurance liability.In the era of rapid development of information technology,cyber insurance is crucial to the sound development of shipping companies,so it is urgent to study the problem of cyber insurance.The article is divided into four parts in addition to the introduction and conclusion,and will discussed in four chapters:The first part is the overview part of this thesis,mainly introduces the basic issues of ship cyber insurance,including the types,characteristics,governance measures and insurance status quo of cyber risks,etc.,which provides a basis for the discussion of ship cyber insurance issues in the following parts.The second part discusses the influence of cyber risks on ship insurance liability.This part mainly analyzes the impact on ship insurance liability from two aspects: cyber risks exclusion clause and seaworthiness under the cyber risk context.Firstly,cyber risks exclusion clause in the insurance contract will exempt the insurer from the insurance liability to a large extent,making the insured almost lose protection when facing cyber risks.Secondly,under the context of ship cyber risks,the seaworthiness of the ship is doubtful,which will lead to disputes between the insurer and the insured about whether the ship is seaworthy.Finally,this thesis argues that under the complex influence of cyber risks,cyber risks can not be covered by traditional ship insurance,so it is extremely necessary to formulate ship cyber risks insurance clauses.The third part,based on the current overseas ship cyber risks insurance,discusses the underwriting issues of ship cyber risks insurance from three aspects: the underwriting mode and insurance coverage,the duty of disclosure of the insured and the cover conditions of the insurer.Firstly,through the study of the current ship cyber risks insurance,the ship cyber risks insurance is divided into three models,and further analysis of their respective insurance coverage.Secondly,under ship cyber risks insurance,the duty of disclosure of the insured also needs to be further analyzed and clarified.Finally,based on the complexity of ship cyber risks,it is very important for the insurer to define the cover conditions.The fourth parts,on the basis of the above analysis,puts forward specific suggestions for the construction of ship cyber risks insurance in China from the two aspects of enriching the connotation of seaworthiness and ship cyber risks insurance system.
