On The Improvement To Judge’s Professional Ethics System In The Internet Age

The life of the law lies in its implementation,and the judge,as the subject of implementation,plays a decisive role in the application of the law.To a certain extent,whether the law can be well implemented depends on whether the judges have the correct professional ethics.This is the internal mechanism to ensure the correct implementation of the law and the implementation of fairness and justice.In the current Internet age,the development of digital media makes judges’ working mode and communication methods different from those in the traditional period.The traditional judge’s professional ethics system has obvious lag,and the generality of its content is difficult to constrain judges’ words and deeds in the Internet age.Therefore,it is extremely realistic and urgent to reconstruct the professional ethics system of judges in the Internet age.Based on the background of the Internet age,this paper conducts research on the professional ethics of judges,mainly from four aspects:First,according to the characteristics of the network age,it leads to the challenges brought by the network age to the judge’s professional ethics system,so as to draw the necessity and reality of perfecting the judge’s professional ethics system in the network age.At present,the regulations on judges’ professional ethics in China are relatively messy and do not form a complete system,which is difficult to restrict many behaviors of judges in the network era.Facing the impact of the Internet age on judges’ professional ethics,how to deal with it has become an urgent problem to be solved.Secondly,based on the background of the network era,this paper summarizes the dilemma types of judges’ professional ethics from the existing perspective.It mainly includes five types of professional ethics dilemma: the impact of judges’ online social behavior on judicial justice,the impact of public opinion on judges’ independence,the impact of unjust,false and wrong cases on judicial credibility,the impact of post system reform on judges’ professional beliefs,and judges’ low income.Third,in-depth analysis of the causes of the above judge’s professional ethics dilemma.The main reasons are as follows: firstly,there is a lack of effective supervision over judges’ network behavior and civil free speech;Secondly,there are defects in the judge’s disciplinary mechanism;Moreover,the post system reform has not achieved the purpose of the reform.Finally,the income level of judges is difficult to cope with the pressure of life.Fourth,some countermeasures to improve the professional ethics of judges in the network era.In order to better improve the judge’s professional ethics system in the network era,we first need to improve the judge’s professional ethics education and judge access rules.Secondly,we need to build a benign public opinion response mechanism to deal with the network public opinion.Thirdly,we need to strengthen the supervision of the judge’s network behavior and improve the citizen’s rational legal awareness.Finally,we need to improve the relevant systems and improve the judge’s professional income.Through the above measures to improve the professional ethics system of judges in the network era.Compared with foreign countries,China still has a long way to go in improving the judge’s professional ethics system.At present,China has gradually paid more attention to the judge’s professional ethics.However,in order to better restrict the judge’s behavior and enhance the judicial credibility,we also need to combine the characteristics of the current network era and make use of the advantages of the network era to improve the judge’s professional ethics system.
