Research On The Dilemma And Improvement Of Community Correction Implementation In Shang Hang County

In December 2019,the law of the People’s Republic of China on community correction was officially promulgated,which provides a strong legal guarantee for promoting and standardizing the work of community correction.Community correction is a new thing.It is an effective extension of penalty execution.It is the mainstream of penalty execution in the world.It is also the epitome of socialization and humanization of penalty execution.The application rate is increasing year by year.The fourth and fifth plenary sessions of the 19 th CPC Central Committee put forward to comprehensively accelerate the modernization of national governance system and national governance capacity.It is an important part of the reform of national governance system that how to strengthen the research on the implementation of community correction in the new situation,give full play to the advantages of community correction penalty implementation,and promote the comprehensive rule of law.With the acceleration of the construction of socialist rule of law,the social and academic research on community correction mainly focuses on how to combine the West with China.There are few researches on the dilemma of community correction executive agencies,executive personnel,executive security,etc.,and lack of scientific and comprehensive discussion.The research on Community correction executive system and executive force system has attracted less attention from the academic circles,and the research on community correction executive force system is not enough It is helpful to enrich the theoretical research results in this field and promote the orderly development of community correction implementation.This paper studies the theory of community correction at home and abroad,analyzes the relevant concepts and current situation,and on this basis,carries out the analysis of the implementation dilemma of community correction in Shanghang County.Relying on the investigation,interview,questionnaire survey,literature,theoretical analysis and empirical analysis,this paper analyzes the implementation agencies,implementation personnel,implementation methods and implementation guarantee of community correction in Shanghang County This paper systematically summarizes and analyzes the existing difficulties in the aspects of obstacles and so on.Through the analysis of the causes of the above difficulties,with the help of the advanced practices of Shanghai and Zhejiang cities and counties,combined with humanitarian theory and new public management theory,this paper puts forward the countermeasures to solve the problems and further improve the implementation of community correction at the grassroots level.By analyzing and summarizing the problems existing in the four aspects of the subject,personnel,nature and concept of community correction,this paper holds that we should attach great importance to the improvement of the subject,especially strengthen the standardized construction of the grass-roots judicial institute,increase the funding of the grass-roots judicial institute,and give full play to the role of the county community correction center.In solving the problem of the strength of the grassroots judicial personnel,we should pay attention to the professional training of the implementation team,and further clarify that the nature of community correction implementation is criminal execution activities,and we should establish a special law enforcement team.In the aspect of community correction task,we should pay attention to the social support needs of community correction objects,and pay attention to the individual differences of community correction objects.In terms of the implementation concept of community correction,the government should purchase services and further improve the implementation effect of community correction with the help of social forces.
