| Social media is defined as a behavioral interaction system with users as the core and relationships as the network.It is also a virtual network and community that enables individuals to create,exchange and disseminate information and ideas,and it has become an important part of contemporary labor relations.A universal characteristic that fundamentally alters work-related behaviour,scope,efficiency and duration.More and more users in the workplace are using social media as a tool for work communication.It shortens the distance between people,and at the same time changes the way of social interaction and expression,and provides a lot of convenience for employers and workers.However,from the perspective of alienation theory,we find that the negative effects of social media are emerging,especially their backlash effect on labor rights cannot be underestimated.The emergence of social media has completely changed the previous employment methods and production environment,fragmented the essence of workers as human beings,and led to the deepening of the alienation of workers,the alienation of labor,relationships,and relationships.character.Alienation in turn counteracts workers’ rights to rest,privacy and personal information.The function of social media is mainly social and expressive.First,social functions have changed the way labor is organized,while social distance and space-time changes have "alienated" labor relations,and employers can break through their legal obligations to hire workers.This has greatly changed the workload and working hours of workers,making the time and space that were originally private to workers indistinguishable from public and private,and seriously infringed on workers’ right to rest.Second,the content of expression is becoming more and more visual.Workers in a disadvantaged position are more likely to expose their privacy and personal information due to the requirements of the employer or the use of the workers themselves.Employers can infringe upon workers’ right to privacy and personal information in more subtle ways.Among them,the right to rest is related to human reproduction,the right to privacy is related to human dignity,and personal information is related to the processing of all aspects of human information.Marxist jurisprudence is against alienation.The report of the 18 th National Congress of the Communist Party of China established the human-oriented legal concept.The human-oriented legal concept emphasizes "people-oriented",combined with the new points of the information age,it should be the proper meaning of the human-oriented legal concept to respect and protect the legitimate rights and interests of laborers.However,there is no special law at the national level to protect workers’ privacy,rest and personal information.However,the employer has formulated relevant internal regulations in a targeted manner,restricting employees in the form of "Labor Handbook" and "Labor Confidentiality Handbook",placing the employer in a privileged position and leaving employees in a "no rights" position.In such a situation,the rights to privacy,rest and personal information endowed by the Constitution and laws cannot be fully protected.In practice,online social media are increasingly used by trade unions and trade union councils,as well as by administrative bodies,which sometimes create their own social networking platforms for collective organization and action purposes,seeking new forms of contact and interaction in order to more effectively to get in touch with a wider range of workers,can they stand up on behalf of the workers and sit down with the employer to negotiate a solution? The author thinks this is a good choice.This article can be divided into six parts:The first part of the introduction states the research background and research significance of this paper,combs the current research status at home and abroad,and expounds the research method and research significance of this paper.The second part raises the question of this article,that is,whether social media poses a challenge to labor rights.Firstly,it introduces the beneficial function of social media,mainly expressive function and social function.Second,it introduces the backlash of social media,including the "self-denial" of rights,changes in labor organization and possible "alienation".The third to fifth parts talk about the impact of labor alienation,relationship alienation,and personality alienation brought about by social media on workers’ right to rest,privacy,and personal information.Through specific case analysis,this part analyzes the laborer’s right to rest,privacy and personal information from the perspective of the relationship between the employer and the laborer,and tries to find out the reasons for this backlash.The sixth part is the summary of the reason analysis of the above-mentioned antiphagocytic effect,and gives possible countermeasures respectively.This part believes that social media does not distinguish between public and private,and the problems of time and space disorder lead to the "alienation" of labor methods.We should give workers more rights and at the same time use legislation to regulate social media applications in the workplace,so as to protect the rights and interests of workers from being violated. |
