AAs a product of continuous development and progress of the current society,biometric information technology brings certain convenient benefits to human beings,but also brings certain troublesome problems.The administrative regulation of biometric information utilization is the most important one,because the current biometric identification is mainly applied to face recognition and AI technology identification,and the extracted information is based on human beings,and the most basic biometric characteristics are extracted to identify the information subject.Such information often has a certain sensitivity and privacy,as the user of information data,the government and related parts of the government in order to enhance the efficiency of information integration and extraction,to facilitate people’s daily life behavior and popularize the use of a large area,for example,the IC chip contained in the ID card,and the recording of fingerprint information;take the car,boat,air and other transportation face recognition of identity verification information,etc.,are inseparable from the biometric identification The application of biometric information technology is indispensable.Accordingly,this article will be divided into four parts to study and analyze the application of biometric information technology.In the first part,we will investigate the meaning and characteristics of biometric information,compare and analyze the differences between biometric information and personal information,and propose the necessity of administrative law to protect biometric information based on the results of comparison;in the second part,we will analyze the current situation of administrative law and regulation of biometric information in China,and find out the problems of administrative law and regulation of biometric information in China.The third part of the paper will analyze whether there is any reference to China’s administrative law and regulations on biometric information based on foreign experience,such as foreign regulatory principles,regulatory agencies and legislative models.Finally,in the last part of the paper,we will focus on the suggestions of how to improve the current administrative legal system of biometric information in China,mainly from three aspects,such as establishing a perfect legislative system,law enforcement mechanism and judicial remedy of the administrative legal system of biometric information,and put forward corresponding suggestions and recommendations for improvement.Finally,it is hoped that this can promote the process of rule of law construction in China,gradually improve the administrative management mechanism of the country and people’s well-being by improving the content of the administrative law system of biometric information,create a more perfect social order,and promote the construction of the modernization of the rule of law system.
