| The system of governmental power and responsibility list can optimize the governmental governance system and enhance the governmental governance capacity.This system meets the practical needs of power supervision and the realistic demands of management services,facilitates the realization of the goal of building a government under the rule of law and a clean government,helps clarify the content of powers and responsibilities among administrative subjects,delineates the boundaries of powers and responsibilities,and improves the efficiency and level of administrative services.In the context of deepening reform and realizing the rule of law,the importance of the governmental power and responsibility list system is very important,and it will be further developed in depth and breadth as an important system of China’s government in the future,however,combined with the practical situation,due to the lack of uniform standards,local governments inevitably have problems when implementing it.In the first part,based on the research and summary of government’s power and responsibility list and system.Firstly,clarify the connotation and characteristics of the list of governmental powers and responsibilities.The connotation of the list of powers and responsibilities is based on the correct understanding of administrative powers and administrative responsibilities.Its characteristics are specifically expressed in the three aspects of normative,administrative and extensive.Further,the system of governmental power and responsibility list is systematically and deeply analyzed from the legal basis,formation conditions,development history and significance.In the second part,we summarize the achievements,problems and causes of the local government’s implementation of the list of powers and responsibilities system in the light of local practices.This system has been effective in realizing the decentralization of government,optimizing the allocation of government responsibilities,and enhancing the awareness and efficiency of government services.However,due to its insufficient legalization,the system is less standardized and its legal attributes are not clearly characterized;due to the lack of capacity of the system’s implementation subjects and their subjective awareness of the list of powers and responsibilities system,there are conflicts of interests between different subjects that are difficult to resolve;due to the inadequacy of supporting mechanisms,including public mechanisms,supervision mechanisms and dynamic management mechanisms,there are conflicts of interests between different subjects in the list of powers and responsibilities system.In practice,there are problems such as insufficient platform construction and public participation,formalized implementation,and failure to update the contents of the list in real time based on the principle of statutory authority.In the third part,the following suggestions are made to improve the above problems.Firstly,the legal attributes of the list of powers and responsibilities,combined with the characteristics of administrative normative documents,are considered to be administrative normative documents.Then,regarding the principles that the system should follow,it emphasizes the basis and value of the principle of statutory powers and responsibilities for the list of powers and responsibilities system.Secondly,for the problems existing in the implementation subjects,through the training of their quality,the administrative subjects are transformed into the wrong concept,so that they can deeply understand the substantial value of the list of authority and responsibility system and improve their comprehensive ability.Once again,the preparation of the list of powers and responsibilities should be standardized from its content,power-making system and procedures.Finally,in terms of operation,we should make full use of information network technology and improve the ability of administrative personnel to improve the public mechanism;combine its attributes as an administrative normative document and propose the improvement path of supervision mechanism in a targeted manner;establish and improve the dynamic management mechanism of the list of powers and responsibilities,so that the list of powers and responsibilities can realize self-renewal and adjustment after publication to meet the requirements of society,and promote the system to achieve stability and continuity in operation.It is hoped that through the empirical study of the local government’s list of powers and responsibilities system,we can further improve the level of local government’s implementation of the government’s list of powers and responsibilities system,avoid the formalized operation of the system,ensure the realization of the system’s value,enhance the efficiency and capacity of local government’s law enforcement,and promote the process of rule of law in society. |
