Research On The System Of Simultaneous Audio And Video Recording For Hearing Opinions In Cases Of Guilty Plea And Punishment

With the promulgation of the Regulations on Simultaneous Audio and Video Recording of Opinions of the People’s Procuratorate in Handling Cases of Confession and Punishment,the trial of criminal cases of confession and punishment in China has entered a new stage.Our country’s simultaneous audio and video recording system for hearing opinions in cases of guilty plea and punishment is a process of balancing the opinions of the accused,the defender or the lawyer on duty to obtain appropriate sentencing opinions,which is led by the People’s Procuratorate.The audio and video produced in this process can provide strong support for the objection or doubt phenomenon in the trial stage of guilty plea and punishment cases.At present,the cases of confession of guilt and punishment account for a large proportion in criminal judicial practice.It is very important to guarantee the voluntariness,authenticity and legitimacy of confession of guilt and punishment.Therefore,studying the synchronous audio and video recording system in the process of hearing opinions in the case of pleading guilty and punishment can improve the procedure of prosecution and defense negotiation,and also provide a new way of thinking for sentencing suggestions,ensuring the voluntariness,authenticity and legitimacy of pleading guilty and punishment.This paper,in combination with the synchronous audio and video recording system of hearing opinions in the case of confession of guilt and punishment,locates the evidence function of synchronous audio and video recording of hearing opinions in the case of confession of guilt and punishment,analyzes the problems in the specific operation of synchronous audio and video recording of hearing opinions in the case of confession of guilt and punishment,and puts forward the improvement path of the synchronous audio and video recording system of hearing opinions in the case of confession of guilt and punishment,so as to better guarantee the legitimate rights and interests of the parties.This paper is divided into four parts.First of all,the first part is an overview of the system of simultaneous audio and video recording for hearing opinions in cases of guilty plea and punishment.This part is mainly divided into three aspects.The first aspect analyzes the emergence and development of synchronous audio and video recording of criminal cases.The second aspect is to explore the theoretical and practical basis of the simultaneous audio and video recording of the opinions heard in the case of confession and punishment.The third part of this part mainly analyzes the necessity of simultaneous audio and video recording of the opinions heard in the case of guilty plea and punishment.Secondly,the second part mainly analyzes the function of synchronous audio and video evidence for hearing opinions in the case of confession and punishment.This part further determines the research direction of synchronous audio and video system in China by analyzing the application of synchronous audio and video system.Thirdly,the third part mainly analyzes the problems existing in the synchronous audio and video recording system of hearing opinions in the case of confession and punishment.This part focuses on analyzing the problems of the simultaneous audio and video recording system for hearing opinions in cases of guilty plea and punishment in China.Based on the "Provisions on Simultaneous Audio and Video Recording for Hearing Opinions in Cases of Confession and Punishment by the People’s Procuratorate",and taking social practice cases as reference,this part summarizes and explores.Finally,the fourth part mainly puts forward feasible suggestions based on the problems existing in the current system and judicial practice,so as to further improve the quality and efficiency of handling guilty plea cases.
