Research On The Application Of Legal Artificial Intelligence In Judicial Trials

At present,the era of big data and algorithm has quietly struck,and the application of artificial intelligence technology is profoundly transforming all aspects of social life.In order to promote the intelligent level of trial system and trial method,judicial organs in various places have established their own legal artificial intelligence systems,and the development of legal artificial intelligence has also risen to the national strategic level.With the enhancement of citizens’ awareness of the rule of law,more people defend their legitimate rights and interests through litigation,which leads to the dilemma of "litigation explosion".The application of legal artificial intelligence has improved the efficiency of judicial work,which can just alleviate the contradiction that there are too many cases at present,enabling judicial workers to devote more energy to major and difficult cases,thus promoting the realization of judicial integrity and justice.However,as a new thing,legal artificial intelligence technology should focus on its advantages while retaining its technical rationality.It should be realized that there are still many problems and hidden dangers in judicial application,which will have a negative impact on the orderly development of the judicial system and judicial cause.Therefore,this paper will start from the application status of legal artificial intelligence,analyze the problems and challenges in the application process,and put forward targeted solutions,in order to better realize its application value in the future "man-machine cooperation" work mode.This article is divided into five chapters.The first chapter is the introduction of the article.In this part,the background and research significance of this article are introduced,and the research status of legal artificial intelligence in domestic and foreign academic circles is summarized.The second chapter is an overview of legal artificial intelligence.This part mainly defines the meaning of legal artificial intelligence,in addition,this part also introduces the technical advantages of legal artificial intelligence in detail.In the third chapter of this paper,the application of legal artificial intelligence in China’s judicial practice is introduced,including its application in case pushing,evidence standard guidance,early warning of sentencing deviation,automatic document generation and electronic file transfer.The fourth chapter is all kinds of problems faced by legal artificial intelligence in the application of our country,mainly including the application problems caused by the technical risks of legal artificial intelligence,the weakening of case fairness by "judging the same case in the same case",the violation of citizens’ privacy rights and the lack of supervision over the citation of legal artificial intelligence.The fifth chapter of this paper puts forward some feasible suggestions for solving the problems mentioned in the fourth chapter according to the current theoretical research and consideration of practical situation,including optimizing the technical development of legal artificial intelligence,combining case fairness when dealing with similar cases,strengthening the protection of privacy and improving the supervision of the application of legal artificial intelligence.In a word,we should treat the advantages of legal artificial intelligence rationally and find a way to make legal artificial intelligence play a better role.
