| Due to the importance of entering the market for rural collectively operated construction land in the process of social and economic development,a prudent and rigorous attitude and principles should be maintained in the practice process.However,how to solve the difficult problems exposed in the market pilot project,in this way,to improve the market entry system,and extend it to more regions and even spread it nationwide has become the focus of urgent attention in academic research.At present,market entry of land for collective business construction in China is still in the promary stage,this is actually a systematic project that persists in continuous summary and development for a long time.So,it will remain one of the important aspects of rural land reform for a long time to come.Since 2015,when the NPC Standing Committee decided to select 33 counties and municipal administrative regions nationwide as pilot market entry,China has achieved outstanding results in this field through a period of exploration and practice.Although the laws and regulations on entering the market are increasingly improving,providing a legal basis for entering the market.However,there are still certain problems in the pilot areas for market entry,the requirements for specific operational aspects are relatively vague and broad.Considering that the existing relevant legal system has not yet been established and improved,as well as the different geographical environment and economic development levels of each pilot area,there are significant differences in the subject scope,and income distribution of entry in different pilot areas in practice.By analyzing the status quo of market entry,the following deficiencies are mainly exposed at this stage: the subject and object of the entry are not clearly defined,the income distribution mechanism for the entry is not yet sound,and the management of the entry transaction lacks standardization.Therefore,based on the shortcomings and causes currently exposed,some reasonable suggestions are proposed from the legal perspective for the promotion of the entry of collectively operated construction land into the market in the future,including clearly defining the subject and specific object scope,besides,ensuring the establishment and improvement of maket entry and trading mechanisms,optimizing the entry income distribution mechanism,and so on,in an effort to clear the obstacles existing in the pilot areas of entry into the market,we will complete the protection of farmer’s legal interests,and play a certain reference role for the market entry system.From the above content,it can be understood that at the present stage,the market entry work still exposes many defects and deficiencies,which need to be further studied.This article puts forward operable suggestions aimed at the practice of market entry legislation,and the related difficult problems in judicial practice for collectively operated construction land,striving to clear the obstacles existing in the pilot areas of entering the market as soon as possible,and then realize the protection of farmers’ rights and interests.Simultaneously,it can also provide a certain reference and useful enlightenment for the subsequent domestic marketing activities of collective operational construction land. |
