A Study On The Development Of International Police Cooperation From The Perspective Of Foreign-Related Rule Of Law

At present,the process of globalization is still advancing.With the nontraditional security issues such as terrorism and transnational crime becoming increasingly prominent,police cooperation among countries is becoming more frequent and close.In order to ensure the long-term,efficient and stable development of the international police cooperation mechanism,and at the same time to maintain China’s increasingly huge overseas interest system due to the deepening of openness,China needs to form a more mature,profound and effective legal discourse and legal system of China based on the existing foundation and achievements of the rule of law.Under this background,from the perspective of foreign-related rule of law,this paper discusses the effectiveness and shortcomings of foreign-related rule of law construction in China’s international police cooperation and the mechanism of foreign-related rule of law,hoping to help improve the level of police cooperation and the ability to protect overseas interests.Foreign-related rule of law is closely related to international police cooperation,and their generation and function are the same in the field dimension;In the dimension of action,both of them take safeguarding national interests as the starting point;In the cognitive dimension,as the basic guide of international police cooperation,foreign-related rule of law can not only guide international police cooperation to build and improve the legal framework,from "rule governance" to "system governance",but also establish the development mode of international police cooperation with the rule of law as the main way,taking into account various ways,and can also promote the basic process of domestic rule of law with reference to individual cases,paying attention to the driving force provided by individual cases for mechanism construction;In the methodological dimension,the concept of foreignrelated rule of law can promote the improvement of the domestic police system of foreign cooperation.In view of the practical nature of international police cooperation,this paper takes the safety risk prevention and control and case management practice of China Railway Express as a research case,and presents the security problems faced by the train,such as cargo theft,smuggling activities,terrorism and cyber threats,as well as the process of shaping the foreign-related rule of law framework of international police cooperation around the train.Based on this,the dilemma of foreign-related rule of law in current international police cooperation is summarized,including the weak foreign-related legal foundation in the field of international police cooperation,the emergence of criminal jurisdiction conflicts,the limitations of international security cooperation platform mechanism and the defects of domestic and foreign police cooperation system.On this basis,the dilemma is analyzed,and the optimization path of international police cooperation from the perspective of foreign-related rule of law is given from three aspects: promoting the development of international police cooperation under the rule of law,broadening and optimizing the channels of international police cooperation,and improving the organizational system and system of modern international police cooperation.
