Research On Service Quality Of Duty Lawyer

The duty lawyer system is a new system of the criminal procedure law in China.To ensure that criminal suspects and defendants get effective legal help is the key to ensure the effective implementation of this system.At present,the service quality of duty lawyers is worrying,which is mainly reflected in the absence of service quality standards,the lack of effective supervision and relief,and the imperfect supporting mechanism of service quality.The improvement of the service quality of the duty lawyer cannot be separated from the cracking of this series of problems,which requires the study of the new characteristics of the legal help of the duty lawyer,improve the new standard of the legal service of the duty lawyer,in order to achieve the high quality and efficient legal service of the duty lawyer.This paper is mainly divided into four parts:The first part studies the service quality of duty lawyers in providing legal help.The research found that the duty lawyer’s legal services are mere formalities,service quality is uneven.Further summarized as duty lawyer service lack of quality standards,lack of effective supervision and relief and the relevant supporting mechanism is not perfect three problems.The second part investigates the service quality problems of duty lawyer in foreign countries and refers to relevant theories about service quality standards and service quality evaluation in order to improve the service quality of duty lawyer in our country.The third part reviews the service quality of duty lawyer theoretically,clarifies the functional positioning of duty lawyer as a "legal helper",clarifies the duty difference between duty lawyer and defense lawyer,and discusses in detail the improvement of service quality standard and the supervision and relief of service quality of duty lawyer respectively.The fourth part aims to put forward some suggestions on how to improve the service quality of duty lawyers.Clarify the minimum service standards for duty lawyers,and formulate a reasonable quality supervision mechanism.In necessary cases,the duty lawyer and defense lawyer docking and conversion,to do their duty.At the same time,the cooperation and protection work of the case handling organs to the duty lawyers should be effectively implemented,the responsibility and enthusiasm of the duty lawyers in providing legal services should be enhanced,and the service quality of the duty lawyers should be optimized.
