| Ever since General Secretary Xi Jinping proposed The Belt and Road Initiative in 2013,China’s overseas infrastructure investment has reached new heights in terms of both quality and quantity.The rapid development of the infrastructure investment industry is accompanied by environmental pollution problems,which not only causes great damage to the environment of countries along the Belt and Road,but also has a negative impact on China’s overseas infrastructure investment activities and national image.Environmental protection work is not overnight,economic priority over environmental protection investment economic concept has lagged behind the current needs of the times.In order to achieve the unity of economic benefits and environmental protection,implement the concept of sustainable development and Xi Jinping’s ecological rule of law concept.From the perspective of China’s home country regulation,this paper discusses the problems of environmental legal regulation in China’s overseas infrastructure investment and the improvement measures from both domestic law and international treaties,in order to maintain a balance between infrastructure investment and environmental protection in multiple aspects.With the exception of the introduction and conclusion,this article is divided into four chapters.Firstly,we will discuss the current situation of China’s domestic investment law regulation of environmental protection in the process of infrastructure investment,which involves the relevant documents and policies issued by China and the bilateral investment agreements and free trade agreements signed between China and the countries along the Belt and Road.Secondly,the problems and causes of China’s environmental legal regulation are analyzed in detail from the perspective of domestic law and international treaties.Thirdly,through a comparative analysis of the specific practices of environmental legal regulation of infrastructure investment in some countries along the Belt and Road and developed countries,inspirational suggestions are made to promote the sustainable development of overseas infrastructure investment in China along the Belt and Road.Lastly,suggestions for improving China’s environmental legal regulation are put forward.At the domestic law level,China needs to enact special legislation on infrastructure investment to enhance the compulsory power of the law.China’s government should enhance the supervision of overseas investment environment before,during and afterwards.China’s judiciary needs to strengthen environmental cooperation with countries along the Belt and Road.At the level of international treaties: China needs to increase the content of environmental provisions in international treaties and enhance the binding force of environmental provisions. |
