Research On Protection Of Industrial Injury Rights And Interests Of Overage Personnel In Jiangdu District

With rising life expectancy,a falling birth rate and an ageing population,China is running out of workers and companies are increasingly keen to hire over-age workers for reasons of cost and proficiency.Due to the consideration of increasing family income or the strong intention of re-employment,some over-aged people re-enter the job market.While exerting their surplus heat,they can also create economic benefits for the society.However,the over-aged personnel have inadequate physical conditions,poor reaction ability,and poor working environment,so they are more likely to suffer industrial injuries in the process of work.However,according to the "Labor Contract Workers",the labor relationship is terminated after the statutory retirement age.How can the government protect their rights and interests in industrial injuries?Industrial injury insurance,as one of the important types of social insurance,can timely protect the basic rights and interests of workers and reduce the contradiction between enterprises and workers.In recent years,the economy of Jiangsu Province has realized leap-forward development,and diversified employment forms are emerging endlessly.In order to apply the employment forms of the new economy,the industrial injury insurance policy of Jiangsu Province has also been continuously improved,and the industrial injury insurance for over-age employees was introduced in 2020,which to some extent makes up for the shortage of over-age employees unable to participate in the insurance.However,the problem that retired employees cannot participate in industrial injury insurance has not been solved,and how to protect the industrial injury rights and interests of the over-aged personnel still needs to get social attention.This study applies the theory of public goods and the theory of government functions,based on the development status of enterprises in Jiangdu District,population,industrial injury insurance fund balance,stock of over-age personnel,insurance rate of industrial injury,incidence of industrial injury,compensation period of industrial injury,identification procedures and other relevant methods and paths,such as questionnaire survey,literature analysis and comparative analysis.The research shows that Jiangdu District has a large base of over-age personnel,insufficient insurance rate of industrial injury,tedious procedures of industrial injury identification,long period of industrial injury compensation,lack of targeted industrial injury prevention,injury rehabilitation effect is not obvious and other problems.Combining with the analysis of the current situation of the government,employers and overage workers in Jiangdu District,it is found that there are many deficiencies in the process of protecting the industrial injury rights and interests of the overage workers in Jiangdu District.Based on this,by studying the industrial injury policies of the overage workers in the United States and Japan and following the industrial injury policies of the overage workers in Sichuan Province and Yangzhong City,this paper puts forward three suggestions on the protection of the industrial injury rights and interests of the overage workers in Jiangdu District:first,for the government:strengthen supervision and management,increase publicity,simplify the process of industrial injury identification and reimbursement,and improve the insurance mode of the overage workers;The second is for enterprises:improve the management mechanism of injury rate,implement the incentive measures of enterprise employment,establish a perfect safety production system;Third,for the over-age workers:strengthen the guidance of rights protection,strengthen the prevention and rehabilitation of industrial injuries.Through the discussion of this study,it is hoped to provide useful reference for the protection of industrial injury rights and interests of overage workers in Jiangdu District.
