In the new era,the development of digital economy and sharing economy has given birth to new forms of economic business,which is undoubtedly a positive change.The new employment pattern is also accompanied by the emergence of new economic business forms,which play a positive role in reducing unemployment rate,promoting social stability,raising national income and improving people’s living standards.Especially in the current situation of economic "anti-globalization" and the continuous COVID-19 epidemic,the demand for labor fluctuates obviously,which provides a perfect opportunity for new forms of labor to appear,and the number of employees in new forms of business is gradually accumulating,becoming a huge group of labor.However,because of the particularity of the employment relationship,the new type of workers encounter obstacles when they participate in the social insurance system.Based on this practical problem,the state has repeatedly proposed to improve the labor social security system and explore the occupational injury protection system suitable for this part of the group,which is conducive to protecting the rights and interests of the majority of new types of workers,and further promote social stability and the healthy and sustainable development of the economy.This paper uses social risk theory,labor relations theory and social justice theory to lay a theoretical foundation for the study of the full text.First of all,the paper introduces the logic and mode of the rise of new forms of employment in China.Based on the questionnaire designed and issued by the author and the 2021 Travel Platform Survey Report in China’s First-tier Cities,the author makes a specific analysis of the living situation of new forms of employment,and concludes that the risks faced by new forms of employment are not guaranteed,but their occupational injury risks are not guaranteed.Secondly,the paper expounds the obstacles faced by new industrial employees to participate in the current industrial injury insurance system,and at the same time analyzes and compares the relevant pilot policies carried out by some local governments,so as to conclude that our country needs to build a suitable occupational injury protection system for new industrial employees.In the end,this paper innovatively proposes that the "employee-industry" model should be adopted to construct the occupational injury protection system specifically for the new industry practitioners,and the opposite relationship between the practitioners and the platform in the protection should be removed to shape the overall risk distribution mechanism.In addition,it puts forward some ideas from three aspects:mode selection,institutional framework and construction of supporting measures.In order to better establish and improve the domestic occupational injury protection system adapt to the new type of workers and make suggestions.
