The technological innovation of the fourth industrial revolution has brought new forms of economic and social development,and accompanied by new employment models has brought new power to our job market,but it has also brought new challenges to the working hour system,so that the extension of working hours in various industries has become the norm,and the protection of working hour rights and interests of workers is generally insufficient.There are some problems in the working time system,such as the absence of standard working time,special working time and the identification of working time.The standards are not uniform and the provisions are not scientific.There is also a dilemma between the administrative approval and labor supervision in the specific implementation of the working time system.In addition,the misbehavior and absence of responsibility of both labor and management and labor union also have a negative impact on the effectiveness of the working time system.By analyzing the problems and causes of the working hour system under the new mode of employment,and combining with the legislative and judicial experiences of the United States,Britain,France,West and other countries to protect the working hour rights and interests in the new mode of employment,such as platform labor,some suggestions are put forward to improve the system: First of all,from the perspective of legislation,improve the level and rigor of the working time system legislation,optimize the standard working time system,improve the characteristic working time system,and clarify the working time identification standards;Secondly,from the perspective of law enforcement,optimize the government approval system,reform the labor supervision system;Finally,from the perspective of the usage of the knowledge law,it promotes the improvement,emphasizes the social responsibility of employers,enhances the awareness of workers’ rights protection,strengthens the construction of trade unions in new forms of business,and makes joint efforts to realize the protection of workers’ rights and interests in working hours under the new forms of employment mode.
