Research On The Influence Factors Of University Invention Patent Maintenance Based On Survival Analysis Method

The Outline for Building China into a powerful Country with Intellectual Property Rights(2011-203)and the 14 th Five-Year Plan for the Protection and Application of National Intellectual Property Rights both clearly state that high-quality creation and efficient application of intellectual property rights should be promoted.As an important part of the national innovation system,colleges and universities have become an indispensable force in the construction of a national intellectual property power.Improving the invention and creation ability and level of colleges and universities is crucial to the implementation of the national intellectual property power strategy.The maintenance of invention patents in colleges and universities not only reflects part of the patent creation in colleges and universities,but also has a direct impact on the transfer and transformation of patent technology.Therefore,it is necessary to study the impact of the maintenance of invention patents in colleges and universities.As for the research on the factors affecting the maintenance of patent,most of the previous researches mainly focused on the influence of the factors on the maintenance of patent at the level of patent literature,and most of the researches focused on the specific technology field,but paid less attention to the specific patentee of universities.Therefore,the purpose of this study is to analyze and verify the research conclusions of existing literatures on factors influencing patent retention time,and explore the dynamic effects of individual characteristics of invention patents and organizational characteristics of university right holders on the retention time of invention patents in universities.Firstly,this paper reviews relevant researches on patent maintenance at home and abroad,including the application of the research method of this paper,namely survival analysis method,in patent research and related researches on influencing factors of patent maintenance.Then,based on the real option theory and the cost-benefit theory,the survival analysis method is used to introduce the characteristics of patent literature,individual characteristics of invention patent and the characteristics of university organization itself into the patent maintenance of university,and a time-dynamic analysis model of university invention patent maintenance survival is constructed.This paper attempts to analyze the influencing factors of patent maintenance decision in universities from three aspects: the characteristics of patent literature,the individual characteristics of invention patent and the organizational characteristics of university right holders.Then,the data of invention patents applied and authorized by 90 National 211 Project key universities from 2007 to2012 were obtained through incopat patent database to make an empirical study on the duration of invention patents in universities.Through empirical research,this paper finds that:(1)patent literature features have a significant impact on the actual duration of invention patents in universities.Among them,the shortening of examination time can improve the actual maintenance time of university patent,and the increasing of the number of claims and pages of specification can significantly improve the maintenance time of patent.(2)Individual patent characteristics have a significant impact on the actual duration of invention patents in colleges and universities.Among them,the improvement of technological advancement and technical stability can significantly improve the patent maintenance time,and the increase of the number of inventors can significantly improve the patent maintenance time.(3)The organizational characteristics of university right holders have a significant impact on the actual duration of invention patents.Among them,the universities with independent technology transfer institutions have longer actual patent maintenance time than those without independent technology transfer institutions.The increase in the number of research and development staff in universities can significantly improve patent retention time.(4)The type of school running and the type of patent applicant will significantly affect the actual duration of patent.Based on the above conclusions,this paper provides some suggestions for patent administration in Chinese universities.
