Research On The Legal System Of Mineral Resources In Qinghai Province

The mineral resources are valuable natural resources on the earth. In the process of the development of human society, mineral resources is not only the source of human life, but also bing great economic benefits for human, with the rapid development of society, the development of mineral resources can’t meet the needs of economic growth. How to make good use of mineral resources has become an urgent problem to be solved. Qinhai Province, which is a big mining province, has rich reserves of mineral resources and various species. But in the process of development it is restricted from the market and environment factors. Which makes it produces in a inefficient speed and cause serious environmental destruction, the waste of resources has become a big problem. Bye the way of learning from other countries’experience, the author hold the opinion that we should think according to the view of economic law so that we can drew better legal measurers for the better development of mineral resources.Firstly, the author summarizes the development situation of mineral resources in Qinghai province, especially the advantage resources. And conclude the characteristics of mineral distribution, the types and the surrounding environment. In the second part, the author analyzes the main problems that exist in the mineral development of Qinghai Province. It includes the analyses of the prospecting right, mining right management system, system of deposit system and environmental impact assessment system. In the third part, the author states the foreign and our country’s mineral legal system and makes a comparison of the four aspects above, in the end the author put forward reference on the basic of the comparison of two countries’legal difference for Qinghai mineral development. Firstly, we should improve the "priority of mining right", by relaxing the mineral prospecting right and appropriating approval standards means to improve difficult situation. Secondly, in the mining industry management system, we should make clear the authority of mineral management and establish mineral resources supervision committee of Qinghai province. We should improve public participation system, strengthen supervision of mining market of Qinghai Province in order to make supervision more transparent and exclude the intersection problem of power level. Thirdly, this paper proposed the methods to improve the Qinghai province environmental deposit system, including determining the only approval and examination department, perfecting the payment and refunding system margin system etc. Finally, in order to improve the environmental impact assessment system of Qinghai province, the author puts forward the methods to develop technical guidelines, strengthen the corresponding dynamic predication function and strengthen the public participation system. Methods of literature research and comparative analysis are used in the paper. It starts from the actual development of Qinghai Province, through comparative analysis of Qinghai province and nation’s and foreign related laws and regulations, the author put forward suggestions for the exploitation and utilization of mineral resources in Qinghai province.
