Nowadays, our country is in the era of transition of traditional society to modern society. Social workers come into being in exact this era of alternation of new and old systems. After developing for30years, social workers have become a beautiful scenery line of the construction of socialist modernization, and important impetus of the construction of harmonious socialist society. However, the development of social workers is far away from satisfactory. As new things, social workers often come across embarrassment and trouble. The reasons for such embarrassment are:the social workers have low income, low awareness and acceptance by the public, and have defects in position setting. The organization of social workers have a lot of problems, ultimately, imperfection of legislation is to blame. To be specific, the legislation of social workers is few in amount and low in effect. The phenomenon of provision and trial is severe. The content of legislation is not complete, existing many margins, such as, the legal concept of social workers is obscure, the right and obligation of social workers is not equal, and the safeguard mechanism of social workers is not perfect and so on. What’s worse, the current legislation of social workers does not comply with the provisions of the authorization. Those problems in the legislation of social workers in our country is disadvantage to the construction of the team of social workers.In order to break the predicament and protect legal rights of social workers in our country, promoting the healthy and organized development of social workers service career, our country must speed up the law and regulation’s research and enact of social workers. By searching a large number of literatures, combing the legislation condition of social workers both domestic and abroad, comprehensively using literature, theoretical and comparative analysis methods, I propose the advices stick to the problems in the legislation of social workers in our country as follows. We should perfect the legislative system of social workers in our country and make a united, special law about social workers, such as, we should make Social Workers Regulations in our country, and define the connotation and denotation of social worker, the right and obligation of social workers, the entry conditions of social workers in the regulation. Besides, the regulation should stipulate the legal responsibility and right remedy of social workers.
