With the development of China’s economy and society in recent years,More and more problems in rural areas,especially in rural areas,more and more serious threat to the living environment of farmers,It is a serious threat to the living environment of farmers,and has a negative impact on the physical and mental health of rural villagers.The phenomenon of rural garbage pollution,Not only pollute the living environment of farmers,on the other hand,rural garbage is also hindering the construction and development of new socialist countryside,does not meet the basic idea of building a new socialist countryside in china,if ignore this problem of garbage pollution,it is likely that when the construction of a new countryside strayed into the first pollution control after the wrong path,deviated from the basic concept of sustainable development of ecological civilization in our country,so pay close attention to the management of rural domestic waste has become the urgent need to solve the problem of building a new countryside.With the deepening of reform,the speed of economic development has been further improved.Now the standard of living in rural areas has been completely different from the traditional way of life in rural areas,with the improvement of the living standards of farmers,the quantity,type and material of rural domestic waste are different from those of traditional rural domestic refuse,this will undoubtedly pose a great threat to human health and safety,but also serious harm to the rural ecological environment.The existing legal countermeasures are difficult to solve these problems,In judicial practice,it is urgent to study the Legal Countermeasures of rural domestic waste pollution prevention and control.The legal countermeasures for the prevention and control of rural garbage pollution are a series of legal measures taken to solve the problem of garbage pollution in the process of daily life in villages and towns.The establishment of rural garbage pollution prevention and control law is an effective way to make up for the current rural garbage pollution prevention and control activities in the market behavior and the need for administrative defects,it is the need of building a new socialist countryside,is the basic requirement of building a new socialist countryside in China,the urgent requirement of building ecological civilization and beautiful countryside in china.This paper is divided into four parts,first of all,the first part outlines the basic situation of domestic waste pollution in rural areas of china,This paper analyzes the current situation of domestic waste pollution in rural areas of Henan province.Secondly,the second part introduces the current situation of legislation and practice of the prevention and control of rural domestic waste pollution in our country,Combined with the investigation results of the rural areas of the town of Zhen Yang,the problems in the prevention and control of rural domestic waste pollution are pointed out.Then,the third part of the introduction of foreign advanced system,analysis of the value of China’s learning experience.Finally,according to the present situation of our country,the author puts forward four legal countermeasures.First,improve the relevant legislation,make up the gaps in the law,improve laws and regulations and promote local legislation.Second,increase the supervision and management of environmental protection,a clear regulatory body,increase supervision.Third,pay attention to the education of environmental protection in rural areas,improve the environmental awareness of rural villagers.Fourth,in the process of garbage disposal,expanding ways to recycling and public participation in the way to reduce the pollution of domestic waste and other four aspects of the proposed countermeasures,We hope to make a modest contribution to the prevention and control of rural domestic waste pollution.
