Marketization and commercialization are the two notable trends after the pre-school education system reformation.With the continuation of this trend,a series of issues have been arisen,such as small quantity of public kindergartens,high tuition in private kindergartens,shortage of kindergarten teachers,low entry requirement and the varied quality of kindergarten teachers and the high frequency of vicious incidents in the preschool education field.The pre-school education system with the characteristics of commonweal and educative nature,is becoming profitable and de-educational systematic without the effective administration by social forces.The issues mentioned above are extremely urgent,especially lack of legislation.Therefore,we should pay attention to legislation and regulation at the same time.Giving priority to the governmental regulation to release the pressure of pre-school education development in order to resolve the crucial issue.It is infeasible to utterly dependent on the financial investment.We should give full play to the role of the ”streamlining administration,delegating more powers to lower-level governments and society,improving regulation and optimizing services" policy,and guide the social forces to enter into the pre-school education field.The government should perform the social management and public service functions and social forces serve as a supplement.The critical reason for the issues above is the legislation gap of the pre-school education system,which lead to the ambiguity of status and nature in the pre-school education field.Accordingly,there are no clearly regulations on industry access system,rights and obligations of kindergarten teachers,criteria and methods of protecting the rights and interests of children,liability and remedy approach.Education is an investment for future,thus protecting children admits of no delay.The governmental regulation should go ahead of the rest under the circumstance of legislation gap.The author analyzed the existing research results and discussed with the problem-oriented method in order to research the feasible way of the pre-school education development.
