Research On The Legalization Of Environmental Collaborative Governance In Hanjiang River Basin

As the largest first-level tributary of the Yangtze River,the Hanjiang River Basin not only plays an important economic function for the sustainable and high-quality development of Shaanxi,Hubei and Henan provinces,but also serves as an important water source for the middle route of the national South-to-North Water Diversion Project,the Hanjiang-To-Weihe River Water Transfer Project of Shaanxi Provinceand the production,living and ecological water of the lower reaches of the basin.Realizing sustainable development of economy and society of our country has great significance.With the continuous improvement of the strategic status of the Hanjiang River basin,the ecological environment of the basin is also facing greater challenges,especially the connectivity of the basin space makes the ecological environment problems inevitably involve the whole basin and have integrity.However,the traditional territorial jurisdiction makes the watershed governance often affected by regionalism,and mostly relies on subsection and element governance,which is difficult to achieve the good governance goal of the whole watershed collaborative governance.Therefore,it has become a new way of thinking to promote the rule of law of watershed environmental collaborative governance.That is,on the basis of breaking the original governance mode,it takes collaborative legislation,collaborative law enforcement,collaborative justice and the construction of coordination mechanism as the main means to adjust the interest relationship of multiple subjects involved in cross-domain environmental problems,and finally coordinate the realization of the dual goals of watershed environmental protection and economic development.This paper first clarified relevant concepts of environmental collaborative governance and watershed environmental collaborative governance under the rule of law,and discussed the legal basis of collaborative governance and the legal perspective of watershed spatial characteristics with theoretical support.From two aspects of laws,regulations,policies and practical exploration,this paper analyzed the current situation of environmental collaborative governance under the rule of law in the Hanjiang River basin.At present,the Hanjiang River Basin environmental collaborative governance of the rule of law still has such deficiencies as the collaborative legislation system is not perfect,collaborative law enforcement is not sufficient,collaborative judicial path is not smooth and so on.Then,it draws on the useful experience of domestic and foreign watershed legislation,watershed management,judicial practice and regional collaborative governance legal model,aiming at the three aspects of collaborative legislation,collaborative law enforcement and collaborative justice.It puts forward suggestions and countermeasures such as improving laws and policies of collaborative environmental governance in the Hanjiang River Basin,strengthening collaborative law enforcement of collaborative environmental governance in the Hanjiang River Basin,and improving the collaborative judicial path of collaborative environmental governance in the Hanjiang River Basin.It tries to provide legal guarantee for collaborative environmental governance in the Hanjiang River Basin by constructing a relatively complete rule of law mechanism.Therefore,it provides ideas for realizing the strategic goal of ecological protection and high quality development in Hanjiang River Basin.
