In this paper,based on the historical time as the main line,supported by a largeamount of historical data,with the text analysis and historical analysis empirical analysis as research methods, in China’s modern higher education,built at the beginning of the administrative law, different periods of the development of the legal text as the logo, the overall classification according to the department of modern administrative law research ways. According to the administrative law in the theory of "subjectivity of new institutionalism, administration and administrative behavior,the theory of administrative remedy for logic main line, to analyze the evolution of the modern higher education administrative law. The comprehensive combed the since the late qing dynasty to the end of the nanjing national government rule in the mainland of China during this period the change of education administrative legal system in our country. Paper stick to the unity of history and logic, summarizes and induces the characteristics of modern education in our country administrative law, reveal and analyze the social background of the modern education in our country administrative body act,on this basis, the research and analysis model architecture education administrative legal system in our country and the influence on the modern education administration.system’s stability and forming stage. In fifty years development history of modern education in our country administrative law, the preliminary conclusions are as follows:The first chapter focuses on the central argument in this paper the research object of the culvert perturbation,education,education administrative law. In fact,this chapter is the education of modern and modern times, education administrative law, the education administration at different times to define the concept and connotations. Westernization school and new university education institutions constitute the specific organization form at the university of the late qing period.The third chapter focuses on the evolvement in the repeated failure to advance higher education administrative legislation. In 1911 xinhai revolution overthrew the feudal autocratic rule of China for thousands of years. Even political chaos and political unrest, the country did not relax the macro management of university. The Beijing government and the ministry of education has issued more than three hundred pieces of important education administrative rules and regulations, and in 1912 "the university","special school to","regulations of public or private school"; "Regulations of the university in 1913 and 1913,the women’s higher normal school regulations,and in 1924 the national university regulations established the higher education in the form of legal nature,status,organization,management mode and function, such as the institutions of higher education by the university,college preparatory, special school,college,and the higher normal school and so on several forms.The fourth chapter mainly discusses the later period of the republic of China higher education administrative law gradually systemized. Nanjing national government in the early education of administrative legislation,occupies an important place in the whole period of the republic of China,is the essential role. Nanjing government after the establishment,as formed by the central government of national unity,relative political stability,economy is getting better; The government pays attention to summing up the experience of the previous period. Attention by way of strengthening the education legislation to implement control and management of education. Prompted the nanjing national government in the early flourishing education legislation,and formed a complete system,form a complete set of education legal system. For future education legislation has positive and significant influenceThe fifth chapter is mainly on the summary of the above chapters,to the modern education the implementation of administrative law influence on later generations and its significance. In the late qing dynasty and the period of the republic of China’s education administrative legislation,for50 years,multiple complex turbulent period,remarkable positive achievements. In a sense,whether the education administrative organization,staff,or the education affairs,almost "every education affairs,all laws". Education administration affairs of each domain,each stage,the education of the republic of China administrative legislation gradually perfect and rich,education administrative regulations formed a very complete large system. In short,China’s modern education administrative legislation,with the aid of education foundation,in the late qing dynasty experienced an interim government and the accumulation of beiyang government,a master of nanjing national government finally be build up a complete field,levels clear,structure is rigorous,technology sophisticated education administrative rules and regulations system, made the climax of education administrative legislation in the history of our country.
