China has about260million migrant workers, whose numbers continue to grow. Theyhave made important contributions to industrialization and urbanization in China, and Chinesegovernment has been concerned about their employment security. Although a number ofpolicies and regulations have been put forward to improve their employment condition as awhole the state of migrant workers employment get overall improved, in reality the migrantworkers encounter worse employment security than the urban labor, which result in jobopportunity get even tougher for them. Chinese economy and social development need themigrant workers, and if the government does not provide them with appropriate employmentprotection, the migrant workers can not resist harm from job opportunity and will be facedwith greater risks, which have a strong negative bearing on the stable and health developmentof Chinese economy and society inevitably. On the basis of the grim current situation oftheir employment security, so the migrant workers employment security mechanism arestudied systematically, and relevant policy suggestions about employment security are putforward by means of a detailed analysis of the security status of the employment of themigrant workers.To begin with, in the paper there is a brief introduction about employment theory, socialsecurity theory and the theory of rights and remedies, which provides the theoretical supportfor the following research. Based on the analysis of data survey, the paper describes theemployment situation of migrant workers, and then summarizes the status quo of theiremployment insecurity. It is found that the employment situation of migrant workers displaylow employment rate, high employment risk, all kinds of employment discrimination and bademployment relief, which originates from migrant workers themselves, government, socialenvironment, employing unit, economical factors and law, which hinder migrant workersfrom getting employment security. So Under the background of interpretation on the urgencyof building the employment protection mechanism of migrant workers, the paper is focused on such entry points as planning and designing of the principles of constructing, the subject ofthe construction and the guarantee mechanism, building the framework of the protectionmechanisms of migrant workers laterally and longitudinally.Firstly, the whole mechanism of the employment protection of migrant workers basedon the order of longitudinal development of the employment of migrant workers, thepre-employment preparation protection of migrant workers, employment protection,unemployment security after employment, and venture protection are described. Thepre-employment preparation protection of migrant workers is based on first employment andsecond employment condition of migrant workers and all kinds of employment safeguardmechanisms are proposed to protect and increase their job opportunity. Employmentprotection, which includes the same employment rights, high quality job, decent employment,safe employment and construction of unemployment alarm system, is a key point in the wholemechanism of the employment protection of migrant workers, and employing unit helpmigrant workers to indirectly protect employment rights and interests of migrant workers.When migrant workers have lost their jobs, the key of employment protection perfect allkinds of social securities to promote their reemployment. Moreover it is urgent to conductrightly their entrepreneurship and give them training in starting businesses.Secondly employment will, employment ability, employment equity and employmentrelief are analyzed laterally and the policies and suggestions of employment securitymechanism of migrant workers are proposed. The policies and suggestions include protectionof employment will, which is based on analysis of migrant workers themselves, their familiesand society and propose some performed protection action measures based on meetingdemand for employment, the law of human resource and cultivation of employment will,protection of employment ability based on the vocational education and training,strengthening of vocational education and upgrading of the rural youth vocational training formigrant workers, the existing problems and ways to improve the level of vocational trainingand education from the government, social and personal perspective of the migrant workersfor raising the employability of the ultimate protection of migrant workers, protection ofemployment equity based on employment discrimination of migrant workers derived fromChinese binary policies and systems, which can be improved by implementing of equity ofemployment, job opportunity and employment rights, and protection of employment reliefwhich is the foundation of right-safeguarding of the migrant workers and draws out theemployment dispute settlement mechanism of migrant workers comprise of confirming thebasic status of consultation system, constructing a multi-level dispute mediation system,improving the existing arbitration system, building a complete employment litigation system, and finally forming the perspective of the legislative, judicial and law enforcement.Purpose of studying on employment protection mechanism of migrant workers is toestablish a special employment protection for migrant workers groups, and ultimately makesit possible for the migrant workers to enjoy the same employment rights as urban workerswhether in urban or in rural areas, to be capable of having a equality, full and decentemployment.There are two innovation points in this paper. One is that From the perspective of formaland informal cooperation, zhis paper propose to set up the cooperative organizations of themigrant workers,and allowe a union to be formed.That migrant workers take part in laborunions which lie in place where their residences are registered. This denies the mode thatlabor unions are attached to their employing unit, adapts to strong mobility of migrantworkers, and is convenient for labor union management and migrant workers application ofright-safeguarding. Rights of migrant workers will be largely protected by the linkagebetween labor unions in various regions. Secondly, before establishing migrant workers union,we should try to set up an informal organization for the migrant workers.They canbe complementary and mutual to provide comprehensive employment security for the migrantworkers.The other is that the protection mechanisms of migrant workers are built laterally andlongitudinally. Measures of employment security are constructed in job tenure order, whichcomprise pre-employment stage, on-the-job stage and unemployment stage. This can increasepertinence and operability of employment security, and then employment security mechanismof migrant workers are analyzed based on employment will, employment ability, employmentequity and employment relief. There are many documents involved in employment of migrantworkers, but few documents refer to their employment security comprehensively. The authortries his best to build the whole protection mechanisms of migrant workers laterally andlongitudinally.
