Research On Technology Innovation Effect Of Intellectual Property Rights Protection

Endogenous technological progress is the source and essential force of economic growth in endogenous growth theory, and technological innovation as the way of technological progress is the most important attention by countries around the world. Intellectual property is the important system guarantee to technology innovation, there is inevitable connection and technical innovation.The protection of intellectual property rights to the effect of technology innovation is not linear, but there is a kind of both can promote may also inhibit the complex nonlinear relationship.Therefore, the protection of intellectual property rights is a "double-edged sword", insufficient protection of intellectual property rights and excess will hinder the technology innovation. If protection is insufficient, enterprise innovation enthusiasm will be decreased with increasing the creation achievements, and excessive protection, involving intellectual property rights of products on the market prices, products will be impeded, the spread of the innovation cost increase, slowing down of innovation. In order to promote sustainable economic growth, should emphasis on intellectual property strategy and technology innovation system of harmonious and unified development. Domestic and foreign scholars on the intellectual property system and technology innovation has been more critical and meaningful research, but most of the literature normative analysis of protection for intellectual property rights are assumed developing country simply to imitate, not to innovate, not considering intellectual property rights protection in developping countries to encourage technological innovation and imitation trade-off between foreign technology. In a small amount of existing literature, although the theoretical framework of the north and south of the original model was improved, and assuming that the developping country is engaged in technical imitation and technical innovation, however, does not take into account the technical level of technology gap with foreign advanced technology, the domestic enterprise technical level, the technical differences between developing countries imitation of foreign technology on the influence of intellectual property rights (ipr) protection policy, as a result, the conclusion of existing normative analysis and empirical research conclusion.Consedering the shortage of existing research, the article based on Yongmin Chen (2005) two department production model, combining the reality of China’s economic development, based on the technology gap at home and abroad, and domestic technical differences in perspective, to use the manufacturer’s profit function and equation of capital gains deductive theory model was constructed to reveal the mechanism of the intellectual property protection for technological innovation, by building, search for all possible variables data to empirically the protection of intellectual property rights in the technology from the perspective of the Provinces in our country and the effect of technology innovation, high technology industry for the correct understanding and in-depth development and utilization of China’s intellectual property rights protection system, the protection of intellectual property rights strategy, promote sustained economic growth and healthy development is undoubtedly has important theoretical and practical significance.Firstly, the paper introduces the optimal patent length and width of patent considerations related to the protection of intellectual property economy theory, for the protection of intellectual property rights and technology innovation theory and empirical studies, the technology gap between technology spillover generalizes the related research results. summarizes the relationship between the protection of intellectual property rights and technology innovation existing three main views:to strengthen the protection of intellectual property rights against technological innovation;To strengthen the protection of intellectual property rights is beneficial to promote technology innovation;Intellectual property protection and exists a complicated nonlinear relationship between technological innovation and IPR protection for innovation may depend on the influence of the technological innovation ability of a country or the level of economic development.Also found that there is a nonlinear relation between distance and technology spillover, technology distance is too big or too small are not conducive to enterprise technology innovation through technology spillovers, distance of appropriate technology is the key to guarantee technology innovation through technology spillover.Description and analysis of the existing research, based on the technology from perspective of the protection of intellectual property rights and technology innovation of theory and empirical research laid the foundation.In this paper, the theoretical model hypothesis:technology distance is the protection of intellectual property rights policy influence on technology innovation mechanism of the structure of the key variables.Then from the technology gap at home and abroad, industry internal technical differences between the two dimension structure, build a theoretical model, intellectual property protection level and the influence mechanism between technological innovation behavior.In constructing a theoretical model analysis the protection of intellectual property rights to the impact of technology innovation, in addition to consider the technology gap at home and abroad, and considering the differences between the domestic technical differences.Regardless of the domestic technology level away from the world technological frontier, the technical level both at home and abroad is put in bigger technology gap is close to the world technological frontier and the technology gap is small, are likely to have two things: one is the balanced development of domestic technology level, different regions and different industries industry technical level, the technical difference is small, the overall technical level is relatively low;Another situation is the uneven development of domestic technology level, different areas and different industry technical differences between industries.According to the above four kinds of circumstances, use the profit function and equation of capital gains in mathematical analysis, technology gap at home and abroad and domestic technology The domestic market competition there is a positive correlation with the enterprise technology innovation.Proposition 3:when domestic technology difference in size changes gradually, technology innovation effect of protection intellectual property rights will exist differet thresholds about intellectual property rights (ipr) protection and technology difference, there is complex nonlinear relationship between them.On the basis of empirical research on theoretical model of the thesis, This paper use the available empirical data from the national macroscopic level and industry an empirical test of medium measure.But this article empirically not entirely confined to the analysis of the theoretical part, when carries on the empirical research, try to consider the actual economic and involved in this paper, the mathematical model is hard to exist in the related factors, to full can more truly reflect the relationship between the protection of intellectual property rights and technology innovation.Concrete can be divided into three parts:the first part analyzes the technical gap at home and abroad is of the truth, the human capital differences lead to the imitation of the protection of intellectual property rights resulting effects on the technological innovation;Another part of various provinces in China were studied under the condition of technical differences, impact of technological innovation of intellectual property rights protection of intellectual property protection and technology difference threshold effect;The third part for high technology industries in our country, using SFA model with the dynamic panel regression model empirically the technology gap at home and abroad and the domestic technical differences under the protection of intellectual property rights and high technology industries in our country divisions the nonlinear relation of technology innovation and the existing threshold characteristics.Finally, In combination with the theoretical analysis and empirical conclusions, this paper concluded and steadily increase the stock of human capital, efforts to improve the proportion of innovative talents, to improve the capacity of technology innovation and accelerate the technology gap between convergence, further implement the strategy of intellectual property rights (ipr) protection, take appropriate protection of IPR and more notice to intellectual property rights achievements transformation, strengthen support for economic development of relevant policy recommendations, and possible future research directions are pointed out.
