Study Of Intelectual Property Protection Stategy For Chinese IT Industry

After China joined in WTO and other international intellectual property agreements, our IT industry will be confronted with a lot of serious opportunities and severe challenges. It is necessary to do some theoretical study for our intellectual property protection from strategic viewpoint, while so far China has not a suitable intellectual property protection strategy for IT industry.This paper has reviewed the development status of IT industry in USA & Japan as well as introduced the intellectual property strategy of them and gained successful experience from them. At the same time, this paper has also reviewed the development status of IT industry and investigated the actualities of protection for intellectual property especially for patent in China, as well as found some questions should be solved. Based on that, combined with Net economy background and the speciality of protection (network externalities, for example) for intellectual property in Net circumstance, this paper has analyzed and summarized the intellectual property protection strategy of IT industry from strategic objectives, tools & models and from macroscopy (government) & microscopy (IT enterprises), as well as described the principals, goals, and measures for this strategy.In the course of analysis, this paper has conducted performance analysis for intellectual property protection, as well as simple model analysis for commercial piracy & user (customer) piracy. This paper has concluded that user piracy may be of benefit to social welfare with impact of network externalities.
