With the development of Sino-US relations from 1980's, the issueof human rights has emerged. In 1989, Tiananmen event push it to bethe core problem of two countries. After that, this issue became one ofthe main controversial disputes between China and U.S. in thepost-cold war era. However, U.S. Congress was always criticizing thehuman rights situation in China and trying to apply sanctions to Chinagovernment. As we all known, the Congress plays an important role indrawing up foreign policy and supervising its process. The goal of thispaper is to investigate the relations between U.S. Congress and itshuman rights policy toward China. And the author wants to makesome contributions in richening the human rights researches and U.S.Congress studies. Moreover, the author also hopes that this paperwould provide some policy bases in how to deal with U.S. Congressand reduce the conflicts in bilateral relations. Firstly, the paper investigated the relations between U.S. Congressand American human rights policy. From historical and functionalaspects, this paper analyzed the key role of Congress in establishingand implementing the American human rights policy. Then, the authorused case studies to pursue further research. In the case ofTiananmen event, the paper explored the response of the Congressand its influence on the human rights policy toward China. Besides,the paper also deeply explored the reasons why Congress reflected sosharply and actively. In the case of MFN and PNTR, the paperdescribed the changes of Congress's attitude and analyzed the reasonof it. Furthermore, the paper probes into a new commission—CECC,which is established by Congress to oversee the human rightssituation in China. Then, in the case of dispute on religion freedom,taking Falun Gong as a typical example, the paper explained thereasons why U.S. Congress would pay more attention to the problem. In the end, the paper comes to three conclusions: 1) the roleof Congress in American human rights policy toward China is ainitiator, drover and monitor; 2) the influence of Congress is very iiimportant and varied in different issue areas;3) it is the political andreligion force that lead the American human rights policy. We shouldall the more observe the American human rights policy towards Chinafrom the angle of domestic politics, economy and religion.
