This thesis is a detailed study on self-management organizations in condominium community, condominium associations in comparative law context, including the nature of condominium associations, their internal and external relationships, their functions, obligations and liabilities, and the affect of government and courts on condominium associations. The purpose of this thesis is to provide reference and suggestions for the improvement of relevant legal system in China through study on theories and practices of condominium associations in other countries.Concerning the nature of condominium associations, if a condominium association was a legal entity, it could enjoy rights, assume obligations and liabilities. It is feasible to make a condominium association a legal entity. Therefore, Chinese laws shall provie options for condominium associations to be legal entities.With regard to internal and external relationships of condominium associations, Chinese laws shall reset the organizational structure of condominium associations either by strengthening the power of unit owner committee as the executive board of the association or making it function as supervision committee. In order to protect the legitimate interests of the unit owner, condominium associations, their directors and officers and property management companies shall have certain duties to unit owners. During the period that the developer controls the condominium community, the developer shall have fiduciary duties to unit owners.Respecting the affect of government and courts on condominium associations, in China, relevant government departments play an import role on instruction and supervision in the development of condominium associations. When condominium associations mature, courts are suggested to assume the responsibilities of the government departments regarding condominium associations.
