Traditional ways of criminal correction in our country have quite a few drawbacks such as low input-output efficiency and low effectiveness in correction. Based on the analysis of the provision of public goods by government, by market and by government and profit-making organization in collaboration, the dissertation, with community-based correction in Shanghai as a case, makes research on partnership of government and the third sector and corresponding institutional arrangement for the provision of pubic goods with greater degree of publicness. Rights and responsibilities and their boundaries of government and the third sector in the institutional model are analyzed and the gap between what is in practice and what ought to be theoretically is dealt with, the reason and the solution of gap discussed.The dissertation makes a systematic research on supply models of public goods and a detailed comparative study of the two models of criminal correction, i.e., prison-based correction and community-based correction after retrospecting the transfer of criminal correction models in Shanghai. The main findings include the following:1) The dissertation, on the basis of analyzing the transfer of supply models of public goods, put forwards that the government can offload to the third sector some parts of the production of pubic goods with greater degree of publicness, thus enriching the models of the relations between the government and the third sector in the provision of public goods and also providing theoretical support for the development of community-based correction in Shanghai.2) The research brings performance assessment into criminal correction and makes quantity and quality cost-benefit analysis of different models of criminal correction.3) The dissertation summarizes the transfer of criminal correction models in Shanghai and analyzes the problems in prison-based correction model and practice in community-based correction model. A comparative study is made between the two models as to main part of the work and the financial input, input and output of public finance, and effect of criminal correction. The dissertation then discusses the experience and problems in community-based correction and suggests ways to construct new relationship between government and New Sailing Community Service Center, improve the performance and narrow the gap between what is and what ought to be. Problems for further research are also pointed out.The significance of the research lies at:1) The dissertation makes an exploration on partnership between government and the third sector for the provision of pubic goods with greater degree of publicness, thus suggesting a third way to solve problems of market failure and government failure in public affairs in cities.2) The dissertation explores the partnership between government and the justice social workers in community-based correction and extends cooperation between government and the third sector in civic public affairs. The research findings will play an important role in helping build partnership between government and the third sector and improve performance of community-based correction practice and thus making prison-based correction and community-based correction mutually complimentary in Shanghai as well as other places.3) The dissertation makes research on the transfer of criminal correction models in Shanghai and analyzing outcomes, drawbacks and strategies in the future of community-based correction in Shanghai from the perspectives of effective supply of public goods and the execution of criminal penalty. The finding in the research will not only contribute to the expansion of community-based correction, the supply efficiency of public safety service and the harmony, stability and welfare of the society, but also have significance in cooperation between government and the third sector in such areas as basic research, compulsory education and healthy service.4) The research is interdisciplinary in that knowledge and methodologies in law and economics, sociology, economics and administration sciences are integrated in the research, which extends perspectives and domains of research on community-based correction and the third sector.
