Study Of Contemporary Chinese Property Rights

The property is the basic condition for production and the life of people and the main benefit for which the people competes. The demands for property is important motive power which promote people to pursue their self-development and the society to pursue efficiency. This demands for property must be assured through obtaining, protecting and enlarging of property rights of people. Economist Buchanon points out that people's property rights have decided the degree of people's freedom, and that the protection condition of property rights has decided to what degree the people's freedom can be realized nowdays. In Contemporary China property has become the material basis for people to develop themselves better. By the analysis of property rights condition of contemporary Chinese, to inspect material basis of Contemporary Chinese's development, then we may find out the situation of human development. To inspect contemporary Chinese's property rights and obtain situation of material basis of human development, property rights will be studyed from four aspects, namely freedom degree of occupation selecting, people's average disposable income, education and human capital condition (symbolic of resource, result and utilization of property rights respectively, and institutional support of property rights by using structure analysis.Firstly people's occupation is the resource of their property rights. The selection ofmore free occupation, more different ways to obtain property rights, so the degree offreedom of the occupation determines the degree of resource of property rights. The ongoingdevelopment and the detailization of occupation has demonstrated society's degree ofdevelopment, also has left the chosen space for people development. The flowing ofoccupation and the trend of continuous development and enlargement of occupation fromjunior to senior also reflect the condition of occupation selection. Especially people's job-freeand free selection of occupation reflects the degree of people's development and the richdegree of resource of people's property rights. Secondly higher the people's disposableincome, more the material wealth for people's development. The difference of disposableincome for different people reflects the difference of people's development capacity. Thirdlyutilization of property rights is mainly to improve people's developing ability. Therefore theinvestment in education enhances the human's ability to gain the property and to promotetheir self-development in human capital. This part is mainly to inspect the condition ofCountry's investment in education and human capital. Finally it is most important thatpeople's property rights should be guarantee by institution. Without the guarantee, theprotection of people's property rights is nonsense. From the aspect of economical, politicaland the legal, we analyze the protection situation of people's property rights, then we canfind out the possibility to obtain their property rights for people. From this structuralanalysis of the property rights, we find that there are many questions about property rightson which contemporary Chinese's development rely. One is the system problem exists in the development of property rights, which mainly appear when the system status is not equal within individual property rights and the collective rights, and that the entering and exiting market mechanism about property right is not perfect. Second is that the wealth polarization tendency causes the differentiation of property rights. Third is guarantee question of property rights, which mainly appear that individual property right is easy to be attacked and the compensation mechanism of property right is not perfect Main factors which lead to the situation are the backwardness of Contemporary China social and economy and culture development> local development disparity and inclining and lacking of policy-, the inconsistence of the system?. the problem of quantity and quality of population and the conflict and contradiction of Collective interests and personal interests.In order to promote human development, it is necessary to continuously protect and expand people's property rights. The Party's 16th representative congress reflects this object demand by proposing that profit should have been yielded to people. It is emphasized the protection of individual property rights that the Second Conference of the Tenth Sessions of National People's Representative Congress pass the Amending of the Constitution, making the protection of individual legal property be read in the constitution. To protect the property rights is reflected the socialism essence and can protect the vulnerable group better and embody social justice. To protect and expand people's property rights, and to provide better material conditions for people's development, it is needed that build well-to-do society wholly and carry out lifelong education and enhance human capital and strengthen the political civilization.
