Intellectual Property Strategies Of Technology Standard Alliance Of Hi-tech Enterprises

This dissertation researched the intellectual property strategies of technology standardization alliance of hi-tech enterprise, the choice and control of the strategies from the perspective of strategy management. As for the analysis of the strategies, this dissertation analyzed the formation, development and complex intellectual property relation of technology standardization alliance of hi-tech enterprise. As for the choice of strategies, this dissertation studied how to choose the development and license strategies of intellectual property. As for the control of strategies, this dissertation explored the allocation pattern of control rights, the information sharing mechanism of intellectual property, the benefit allocation mechanism and the conflict harmony mechanism of intellectual property license.Based on the concept of technology standard and technology standardization, this dissertation defined the connotation of technology standardization alliance of hi-tech enterprise from the theory of strategy management and transaction cost, and classified the technology standard from the perspective of intellectual property. Through analyzing the mechanism between network externality, network structure and technology standardization, this dissertation put forward the basic strategy pattern for technology compatibility, and demonstrated the strategic advantage of saving transaction cost and promoting the performance of knowledge conduction for technology standardization alliance.Technology standardization alliance is a quasi-market contractual governance structure from the formation and development of technology standardization alliance. The dominant enterprises of technology standardization alliance, their true strategic motivation is to diffuse the technology standard that benefits them through alliance cooperation and the adopting intellectual property strategy, and enlarge the user scale which could gain the monopoly profit. Technology standardization alliance promotes the technology standard to upgrade, consummate and industrialize.This dissertation demonstrated the three basic ways that intellectual property merges into technology standard and analyzed the three basic relations of intellectual property including the competition, hindrance and complementary relation, and analyzed the mechanism between the three relations and intellectual property choice, alliance structure and technology innovation. Through defining the basic types of intellectual property strategies, the preemptive game model of intellectual property development was constructed from the investment level, stage and R&D information lagging. The process of intellectual property development was classified into three basic stages including basic patent developing, subordinate patent developing and international diffusing of technology standardization, and the stage game model of intellectual property development was constructed. According to the patent lacking in our hi-tech enterprises, this dissertation put forward three intellectual property strategies including rational strategy of retreat without fight, quick fight or retreat aggression strategy and defendable following strategy. After summarizing the imperfect characters of intellectual property in the technology standard alliance and exploring the alliance structure and patent license, this dissertation constructed game framework of strategy choice of patent license and summarized the mechanism and law of patent license.This dissertation demonstrated the control base of intellectual property of technology standard alliance and explored the mechanism that the control rights allocation pattern affects the information disclose and R&D effort of alliance enterprises. This dissertation also analyzed the self-motivation of R&D information sharing and constructed the information sharing system of intellectual property development. This dissertation demonstrated the feasibility and corresponding measures of tournament mechanism, sharing mechanism, punishment mechanism and dismissing mechanism. And then this dissertation analyzed the different efficiency of intellectual property, international conflict and protection mechanism of intellectual property license.Finally, this dissertation selected the typical technology standardization alliances of hi-tech enterprises as the investigation objects including DVD, DVB, ATSC, 3G, OASIS, UN/CEFACT, MP3, AVS alliance etc. Through the empirical investigation this dissertation demonstrated the operation status and operation law of intellectual property strategy of alliance. The policies and suggestions of intellectual property strategy of alliance were put forward.
