Study On The Reform Of Collective Forestry Property System

From the perspectives of forestry and law, this essay, looking back the all previous transitions of forest property system since the founding of new China, thinks that the development of the times and new countryside construction puts forward urgent requirements to the reform of collective forest property system. At the same time a series of policies of central government and helpful experiences in Fujian and Jiangxi province provide more mature conditions for extending the reform. Because there are great differences among nature, economy and culture in our forest areas together with complicated historical matter, it is important to summarize the experimenting phase, discuss the problems in the reform and solve countermeasures for the scientific development of collective forest property system reform. The essay briefly expounds property characteristics of forest resources, necessity of the Real Right Act for forest property legislation, revising and complementing of related Laws and Regulations, issues to be coordinated in the reform and countermeasures, centering on the development and research status of our reform of collective forest property system, foreign practices and experiences of private forests. This research compares and draws lessons from foreign advanced practices on the private forests management and puts forward reform direction on our collective forest property system. From the point of view of history and reality, starting from the problems and combining with production practices, this essay evaluates the reform performance qualitatively and quantitatively with empirical approach and data analysis on the successful experiences and practices in the major forest regions in Fujian province. With the goal of policy complement, the essay discusses and makes a detailed policy suggestion on establishing and perfecting the service system of forest socialization, forest investment and financing policy and forest insurance system.Preliminarily discusses some issues needed to be revised, such as subjects ambiguity in the forest property legislation, ill-defined connotation and denotation of forest resource concept, disputes about the object of forest property, disagreement about the concept of forest land, restrictive clauses of tort law in the forest property management. Preliminarily research the principles of protection by law, Policy Stability, ecology priority, human orientation, Multiple Subjects, social forestry, Comprehensive development and multi-industries coordination of resources protection and management. This essay especially proposes to reinforce the soft environment construction on collective forest property system reform when the reform shows effective and is overall spreading. The emphasis is on strengthening to educate the forest farmers about the sustainable development of ecological environment, raise their environmental awareness and sustainable development ability. This is the requirement of new countryside construction and scientific sustainable development of collective forest. Forest farmers'environmental awareness and sustainable development ability determine success or failure of the reform.
