The Reform And Improvement China's Collective Forest Right System

It is a delightful and sad result of the seventh national forest resources survey. Not only does it show the great achievements in the forest resources, but also exposes the serious situation that the forest resources are facing to. If there were not scientific and reasonable ownership arrangement in the system design, it will definitely lead to waste of forest resources, the ecological imbalance and affecting human life. All of those are lead to a serious threat to sustainable development of our economic and social. In order to make forest resources fully and reasonably utilized, the system of forest right has become inevitable to study. At present, the reform of collective forest right system has become a hot issue concerned widely by academic and community, and It is the basic theory of improving the system of forest resources of property rights; it is related to the lifeblood of the vital interests of forest farmers; it is also the inherent requirements of the socialist market economy and ecological civilization, and that is why I choose this topic.On the basisi of the concept of the forest right has been defined. I analyse the characteristics and the legal relations of the forest right, and resolve the issues on the forest right. I also demonstrate the theoretical foundation of the forest right system. Furtheremore, forest right is a complex and comprehensive concept, thus the theory for the forest right system is related to the economic theory, legal theory and ecological theory.The sustainable development is the nature pursuit of forestry property right reform, and the origin, production, content and other aspects of sustainable development provide a theoretical premise for the reform of china's collective forest right system. Next, in order to better develop the future, I analyse the history of reform of the collective forest right system. Analysis of each stage of the background, policies and systems shows the pros and cons of the reform of collective forest right system in that era, and provides a historical reference for reform in future,at the same time it points out the direction of the times.After stating the theoretical analysis of the preceding chapters and intruducing the successful experience and cases of reform of collective forest right system in the individual pilot, I describ the progress and innovations of the reform of the current China's collective forest right system, and point out the major issues and challenges that China's collective forest rights reform faces to. Considering these problems and the present, in the last part of this article I propose to improve China's collective forest right system reform as policy suggestion, and state the definite rights and obligations for forest famers, which puts forward the goals and development direction of the reform of collective forest right system. In the final conclusion part, I give a prospect for the reform of the forest right system and collective forest right system in China, and hope to develop a low carbon economy so as to protect the ecological civilization.
