A Study On The Theory And Practice Of Human Rights Of The Communist Party Of China Since The CPC Sixteenth National Congress

The SARS happened in 2003 highlighted human life and human values from the other side. The constitution added "state respects and safeguards human rights" clause in March 2004. The Chinese communist party leads government and people paying more and more attention to human rights theories and human rights practice, since the sixteenth congress party’s theories of human rights and human rights practice got a nice and fast development. Studying party’s theories of human rights and human rights practices, both for the international human rights field and for the civil human rights, have important theoretical significance and practical value.So far, there are five copies published works, which specially discussed the theories and practices of human rights of national leader. Since the 16th national congress of the CPC, Chinese government and Chinese people under the lead of the CPC with Hu Jintao as the core paying more attention to the construction of Chinese human rights. To explore the theory and practice of human rights of the CPC since the CPC 16th national congress taking the CPC since the CPC 16th national congress as the subject is still an attempt. I hope this attempt to the theory and practice of the human rights of the CPC helpful.The introduction of this dissertation discussed some necessary premise matters about writing this dissertation. Firstly, starting with the basic theories of human rights, the main part of this dissertation discussed human rights and the developmental course of human rights, here, discussing the basic theories of human rights from abstraction to specific, from logic to historical. Secondly, the main part of this dissertation discussed the origin and the substance and characteristics of the human rights of the Chinese communist party since the CPC 16th national congress. From the viewpoint of human rights of Marxism to the human rights results in Mao Tse—tung thought, Deng Xiaoping theory and the important thought of"three represents" to the related human rights thought in the Chinese and Western culture, the theories of human rights of the CPC since the CPC 16th national congress respectively adopt the manner of inheritance, absorption and learning. The substance of theories of human rights of the CPC since the CPC 16th national congress include:The constitution and the law is the basis of human rights protection, people—orientation which is the core, right to exist is the root of party’s human rights theories, the right to development is the goal of party’s human rights theories. The characteristics of the theories of human rights of the CPC since the CPC 16th national congress include:the highlight of the human valve, the all—round development of human rights, a focus on human rights to carry out, the dialectical unity nature. Thirdly, the main part of this dissertation discussed the practices of human rights of the CPC since the CPC 16th national congress. Human rights practices of the CPC since the CPC 16th national congress are respectively from two aspects of domestic and international discussed. Domestic aspects include:the protection of human rights in the economic field, the equality of human rights in the political field, the diversity of human rights in the cultural field, the harmony of human rights in the social field, the justice human rights in ecological field. International aspects include:the attend into international activities in human rights field, the join in international text about human rights issues, the development of the human rights dialog and exchanges and cooperation, firm position in sino—us human rights struggle. Fourthly, the main part of this dissertation discussed the problems and challenges and causal analysis of party’s human rights. Finaly, the main part of this dissertation analysed the path to strengthen the party’s human rights construction. The conclusion of this dissertation pointed out the openness of party’s human rights theories and the progressive of party’s human rights practicesthe and the prospect of future human rights.This dissertation comprehensively used materialistic dialectics, the method of logic and historic uniform, the comparative method, the systematic method, the value analysis method and other methods to study the theories and practices of human rights of the CPC since the CPC 16th national congress. I hope the writing of this dissertation for maintaining sovereignty, promote human rights, opposing hegemony, to construct a harmonious society and the building of a harmonious world have trifling significance in theory or in practice.
