Counterpart Support Ethnic Minority Areas Under The Rule Of Law Research

Counterpart support system is an important institution to support the development in underdeveloped ethnic areas of China, which has important strategic significance in safeguarding national unity, reunification of the motherland and national security, realization of the third strategic target of modernization, implementation of the western development strategy, and providing assistance for the economic and social development in undeveloped national regions, etc. Counterpart support legal system belongs to the fields of ethnic law and economic law research, and the paper attempts to build the theory supporting system and legal security system of counterpart support legal system through multidisciplinary analysis. Improvement of the counterpart support system will more effectively solve the problem of unbalanced development of east and west, also implement and achieve two overall strategies Deng Xiaoping put forward, so as to fulfill the goal of common prosperity.Since three decades ago when the central government put forward counterpart support in1979and the national support the border was proposed, counterpart support system has been gradually developing to establish government guidance, market-oriented mode counterpart support long-term mechanism. Through establishing standardized counterpart support legal system, China has developed a mutually beneficial counterpart support and win-win situation under market economy conditions, further standardizing the behavior of the government to promote the effective operation of the counterpart support funds in accordance with the rules of the market, and acchieving the maximum economic efficiency and the effect of radiation pattern development. However, current counterpart support system still has very strong characteristics of planned economy, and the enterprise and the market have not played a leading role yet. The support is still dominated by movements, slogans, compulsion and free way, which fails to effectively play the lever function of market economy, fails to establish a standardized legal system, and can not effectively adopt legal means to standardize the counterpart support and clarify the rights and obligations of all parties concerned in counterpart support in the form of law.Based on the great importance of counterpart support in China, and the urgent need for the scale and benefit of counterpart support, especially the need for balanced development of east and west China, and common prosperity and the goal of the comprehensive construction of a well-off society, this paper puts forward demands for counterpart support in the legal framework and the building of a perfect legal system of counterpart support.This paper mainly applies methodologies such as the historical literature analysis, empirical study and comparative study. We organized a team to conduct field research in Qiandongnan Miao and Dong Autonomous Prefecture and counties and the city of Anshun Zhenning Buyi and Miao Autonomous County in Guizhou Province, carrying out for poverty alleviation and assistance visits and interviews. A systematic data collection, collation and analysis for the current status of Qiandongnan Prefecture and the counties corresponding supporting, makes the analysis in the paper more accurately to find out the core and the crux of the problem, and ensure that the research has theoretical and practical value.This article is divided into six chapters. The introduction discusses the significance of the topic, research status, research framework, research methods, innovation and deficiency. The first chapter of the paper generalize, analyze and refine the concept of counterpart support, history, manifestations. The chapter2examines counterpart support in national fundamental policy, in combination with the western development strategy, poverty alleviation collaboration and the expression of counterpart support in national important policy guidance documents, all-round display and clarifies the important position of counterpart support in the whole country governance, in order to grasp the overall situation and analysis of the development and status of counterpart support system, prominent the certainty and necessity of counterpart support rule of law. The chapter3from the national political system, development theory and the law philosophy depth analysis of the operation of the counterpart support, deeply explore the counterpart support mechanism deep run base, extending the objective necessity of counterpart support legal system. Combined with the practical situation of interviews, the chapter4summarize and analyses problems of counterpart support system in seven aspects, find out and analyze the crux of the problem, in order to solve the problem better, based on this to discuss the improvement of counterpart support system. The Chapter5analysis the Chinese dynasties promote the implementation of national regional development practices, especially the implementation and experience of the "association" in Qing dynasty, and briefly introduces the related measures which are taken to promote the development of underdeveloped regions in foreign countries, hoping that through combing and summary to learn from the mature experience. The chapter6Perfect the construction of counterpart support legal system, including the perfection of work mechanism, the choice of path and the legislative idea of counterpart support, focuses on dialysis and build counterpart support legislation of the paper, explores the legal system construction of counterpart support theory system under the rule of law.The analysis in this paper is still superficial, more system and depth research is needed in counterpart support legal system.
