Condominium in Macau, as one of the main forms of realty ownership, including the rights of units and of common area, is a compound right. Some scholars argue that in addition to the two rights, also includes the right of membership in condominium management. Although triadic theory of condominium was not accepted in Macau, management problem is also defined in the condominium law as an important part, and a lot of controversies and problems arise from it. This article discusses on the legal system of Macau condominium law, in addition to two main parts(unit ownership and co-ownership), condominium management system is also an important content.After return to China, high-rise buildings increase quickly in Macau, which brought many problems urgently to be solved. Therefore, study on the legal system of ownership especially condominium law is necessary.There are at least hundreds of residents in a high-rise building or a new residence community, as a result, condominium management has become a complicated thing, and good condominium management is becoming more and more important for the harmony of the society.This paper is divided into seven chapters to discuss legal system of condominium in Macau.The first chapter is about Macau condominium’s evolution from the view of history, and introduces the development of condominium management system in Macau.The second chapter comments on Macau condominium law and its theories, including the nature of condominium under different theories, and compare the difference between these theories.The third chapter introduces condominium’s setting and change in Macau, and discusses setting mode and content of the right.The forth chapter discusses on the object of condominium, making a comprehensive analysis of the Macau condominium, including proprietary part, common part, and the ownership of parking.The fifth and sixth chapter make a research on the two important organs in buildings, and points out the relationship between them from the view of law, and presents the confusion of condominium management authorities. Through the analysis of cases in Macau, this paper also put forward the path to solve the problem.The last part of this article also studies the related problems of maintenance and repair of existing building, especially the shelf life and maintenance responsibility in the case of the flaw.
