Research On Problems Of College Student Association

University students’community construction is being paid more and more attention during these years because of its special influence. Especially after2004when the Central Committee of the Communist Party of China and the State Council released the Suggestions on Further Strengthening and Improving the Ideological and Political Education of University Students (CPC released [2004] No.16), university students’ community construction plays a more significant role in the field of university students ideological and political education.But unfortunately, the research of the university students’ community is still on the initial stage, and there is no clear thought on problems caused by time development. On the one hand, it is because the country does not have a perfect law construction and management methods of the social organization management, and there are also obvious problems which are ambiguous and unclear on the legal status of the social group, the relationship between rights and obligations, and the definition of juridical association. On the other hand, to a large extent, the specific characteristics of university students’ community itself block the effectiveness and appropriateness of self-control ability and force from the outside during the university students’ community management. The fact that the researches on university students’community are of importance but the current research situation can not satisfy the reality needs provides beneficial opportunities for this study. Based on the existing problems during the development of university students’development, three aspects are deeply investigated in this study.First of all, it is to explore the legal status of university students’ community. This part tries to systemically comb the legal status of university students’ community in order to make it explicit and then define the relationship between rights and obligations inside legal limits. There are three conclusions about this:firstly, university students’ community can be regarded as autonomy organization inside the university because it organizes activities inside the university. This kind of organization should register and put on records in related university departments according to the related laws and regulations, and accepts the corresponding management and does not need to apply, register and put on records in the civil administration departments of the governments of all levels. Secondly, university students’ community is attached to the university (the definition of this is still controversial inside the country). From the legal point of view, it can not take corresponding responsibilities and does not have legal capacity. Finally, even though university students’community does not have corporate qualifications, it in nature is an organization which is voluntarily made up of university students to achieve their common goals. As a result, university students’community still has the right to self-manage and self-organize, but the realization of these rights should be based on the laws and regulations. Accordingly, to lay further ground for analysis, this part deeply analyzes and elaborates the relationship between university and students, the relationship between university and university communist youth league organization, the relationship between university students’community and university communist youth league organization.Second of all, it is to analyze the problems during the development of university students’community. This part aims at existing researches’findings, and it systematically analyzes the obvious problems happened during the development of university students’ community, such as insufficient self-control ability, expansion of self-control, lack of driven force from outside, as well as inner lead of driven force from outside of the university students’ community. Besides, this part analyzes the negative consequences which occur along with the above mentioned problems. On the one hand, these problems directly lead to the lagging behind of development and the organization dissimilation. On the other hand, those problems become a barrier in the positive role playing of the university students’ community. Overall, the reasons why university students’community meets many problems during its development are caused by several factors, and these are shown as the following four aspects:the first is the unbalance of the "two forces" during the development of university students’ community; the second is the lack of regulations during the development of university students’ community; the third is the complexity of university students’ community itself; the fourth one is the environmental diversity of the university students’ community. The clear understanding of those aspects helps put forward the effective strategies for solving the problems of university students’community.At last, it is to analyze the developmental strategies of the university students’ community. By combing reality and based on existing researches, related strategies for solving problems during the development of university students’ community are put forward. The research mainly proceeds form the legal status of university students’ community, and sets out correctly playing the rights and obligations. It is based on governance theory, with the views of appropriateness, balance, and multi-dimensions, and tries to put forward reasonable ways of university students’ community in the level of more subjects involved, appropriate degree involved, and multi-dimensions involved in order to enable the development of university students’community to go back to reasonable and proper track.
