A Study On The CBA Professional League Regulation Mechanisms In China

In the reformation and development of China’s basketball career, establishing aperfect professional basketball league is the direction. It is the requirement of thetransformation from competitive sports to professional sports, but also the need of theinnovation of professional sports system in China. Fund-raising, system innovation,using foreign players, clubs’ construction and players compensation have beenpositively promoted since the reformation of professional league appeared. However,our CBA professional league is still at the primary stage presently, and there existmany questions, such as the rigid system, the non-standard management, the insufficientreservation of talents, the declining athletic performance, the poor materialization clubleague and so on. Especially in the league supervision mechanism construction, there isa larger gap compared with NBA, which is mainly reflected in the league framework,the concentrating regulatory power, no pattern of supervision power of checks andbalances. League regulation institution is not scientific and lacking of professionaltalents; league regulation legal system construction is slow, while discipline violationpenalties are lighter. League fails to fully release and supervise such phenomena as“basketball fraud”,“basketball betting”,“black whistle”,“drug”, false contracts,financial operation opaque, agent irregularities, etc. Thus, it needs to be improved.The paper intends to give advice to the relevant departments and institutions inorder to provide them with reference and suggestion, to perfect and improve the level ofCBA league supervision mechanism in our country. By using the method ofdocumentary, expert interview, questionnaire, field observation, mathematical statistics,case analysis, comparative analysis and fuzzy comprehensive evaluation method on thetheoretical foundation of the regulation of China’s CBA league, this paper studies theleague regulation development evolution, the construction situation of supervision mechanism of positioning, guiding ideology, constructing principle, influence factors,the operation of the supervision mechanism, the successful experience of NBAprofessional basketball league supervision mechanism and supervision efficiency ofcomprehensive evaluations. The following conclusions are drawn in this paper:Firstly, in the present system, regulation of administration is given priority to theleague regulation, and regulation is attached to running, which caused many problems.For example, the "one-side regulation", the concentration of regulation power, thefailure of supervision and regulation, the insufficient regulation of league regulators, thelack of league regulation mechanism innovation, the failure of establishing independentthe third supervision institutions in the league, and low regulatory efficiency, etc.Secondly, NBA league has established an effective and scientific regulatoryagencies, which give full play to the regulatory functions. The league is running inaccordance with the law regulation with severe penalties and high efficiency;Professional referee system ensures the fair competition of the match; The leagueimposed the unity of macroscopic regulation and zoning regulation system; it sets acooperative and efficient model of supervision combined with the United States CentralIntelligence Agency, the central bureau of investigation and the United States Court.Thirdly, the purpose of professional league regulation mechanism is to create a"fair, equal and open" competitive environment, establish a supervision warning andinspect mechanism, and improve the effect of regulation, reasonable configurationleague resources and the scientific management level. Factors like administrativesystem, professional league regulation legal system and policy, construction of the club,league development goals and the professional basketball market maturity influenceChina’s CBA league regulatory mechanism."Policy and law, legal system, collaboration,mechanism design, independence, fairness and openness and the control of cost" are thebasic principles of league regulation mechanism.Fourthly, relevant Chinese Professional Basketball League Rules should be made;"management-running separation" should promoted and speed up; supervisorynegligence responsibility system should be established; independent regulators in theleague should be established; professional talent should be hired; the conventional approach and specific approach should be both applied; economic, administrative andlegal regulation means should be used to monitor the behavior and activities ofprofessional league in China.Fifthly, regulation of CBA professional league was divided into administrativeregulation, industry regulation and social regulation. Relevant laws and regulationsshould be made to realize and ensure the function of supervision mechanism toformulate and perfect the league; public security, prosecution, and legislativedepartments should be coordinated in order to give play to comprehensive regulationability; club construction should be standardize to give play to the basic decision role ofmarket allocation of resources; the level of league and club scientific managementshould be improved; a fair and harmonious league competition environment should becreated; League of punishment regulation system of relief should be build up.Finally, an investigation on CBA league regulation efficiency in our country wasmade comprehensively. The result shows that78%of people think that administrativeregulation model is efficient;75%think the industry regulatory model is efficient, and47%think that social regulation is efficient. On the basis of this investigation, a dualmode of administrative supervision and industry regulations of the league should beadopted, while social regulation model should act as a useful supplementary leagueregulation.
