"In ancient Kang, today there are Wai Jianv" is the realistic characterization for the behavior of the Wai Jianv rights petition in NH local. This statement not only reflects the status of local Wai Jianv Rights petition, but also reflects the plight of the difficulty in implementing Wai Jianv’s rights. This study through the perspective of gender to explore about the Wai Jianvs rights and interests and its implementation problems.Therefore, the purpose of this paper consists of three:firstly, by analyzing the reasons of the Wai Jianv problems emergence to understand the phenomenon of Wai Jianv maintenance of rights;secondly, through investigating the struggle of the Wai Jianv and the villagers,the struggle between the state will and the village society to understand the social ecology environment of Wai Jianv maintenance of rights;thirdly, using the Gender Perspective to deconstructe and reflect Wai Jianv phenomenon involving the interaction of the main,thinking Wai Jianv on rights awareness and rights protection instruments,reflecting the implemention of the plight of Wai Jianvs maintenance of rights.This paper uses a gender perspective,which stresses deconstructing the social system,the members thinking way and the habit of gender discrimination that existing in the community.This article follows this framework:Event Comprehension Analysis-reflection mode.Firstly, we should analyze the social reasons for phenomenon of Wai Jianv,then Followed by analyzing the process of interaction of Wai jianv’s rights petition,there are two main interaction processes:one is Wai Jianv wrestling with the villagers,the other is thegame between national will and rural social order, so that we can know the relevant actors’ reactions and strategies in the process of the Wai jianv’s rights petition;Finally the author focuses on the rural social order of the implementation of the Wai Jianv’s interests,the modern rights awareness and the policy enforcement system to reflect the difficulties in the Wai Jianv interests implementation. This paper is divided into three parts:At first, the author analyzes the reasons of Wai Jianv phenomenon. Through the analysis of basic social causes, the causes of the problem of Wai Jianv can be framed in this backgrounding:the context of social transition government to maintain stability and create a political environment of harmonious society, the social environment of economic developmentsocial differentiation,and traditional cultural influences Wai Jianv rights protection cultural environment.The second part is a dynamic analysis process. It includes two sections.The one section is to do microscopic interaction analysis of the struggle between the Wai Jianv and villagers.The other section is to do interactive analysis of the macro between the will of the state and the village social order. According to the analysis of the process,we should understand interactions involved in the process of Wai Jianv rights, analysis the resources and strategies they use in the interaction,probe background environment of the Wai Jianv rights and the implementation.The third part is the deconstruction and reflection.The analysis of the Wai Jianv’s rights petition behavior from the social gender perspective is a process of the deconstruction of the Wai Jianv’s rights petition and the social ecology,this is a gradual process of decomposition and reflection.According to deconstruction of the Wai Jianv,the villagers as well as policy formulation and implementation,we can analyze the Wai Jianv’s purpose behind their actions,then it is easy for us to distinguish their objectives.from the modern benefits sense and the village social order to reflect,from the perspective of the improvement of the social institution system to reflect,reflecting why the Wai Jianv’s rights are difficult to implement.
