Research On Innovation Model And Intellectual Property Protection Of Internet-Based Service Industry

This research mainly focuses on three parts:the innovative models of the Internet-based service industry, the intellectual property (IP) protection methods of Internet-based service industry, and the relationship between the innovative models and the IP protection methods. The paper started with the review and clarification of the development course of internet-based services, and drawing on related theories such as innovation management and service innovation theory, industry analysis theory and theories of network economies, it defines the innovation contents and innovation models of internet-based service industry, and builds the analytical framework for innovation models research in internet-based service industry. Employing theories of network economies and protection of intellectual properties, this paper constructs the protection systems for intellectual properties in internet-based service industry. On the basis of the first and second parts of research, this paper takes a further step and conducts some empirical analysis about the relationship between innovation models and protection methods in internet-based service industry, using statistical tools as methodologies. Lastly, a comparison of related policies in different countries is carried out, and some policy recommendations are as well put forward for the development of China’s internet-based service industry.The main results and conclusions of this research are as follows:Firstly, the analytical framework for innovation models in internet-based service industry can be divided into three layers, namely inside layer of business model innovation, intermediate layer of technologies and standards, and outside layer of organizational structure. From the inside layer of the framework to outside layer, the tangibility of knowledge in different layers will increase gradually, and different layers are interrelated and will mutually reinforce each other. The innovation models consist of technological innovation model, organizational innovation model, standard innovation model and business model innovation.Secondly, the internet IP protection system primarily consists of traditional IP protection methods, contracts and some other new methods, which include trade secrets, information disclosure, leadership strategy, documentation, technical protection, job rotation, limited access to information, responsibility split, establishment of employee loyalty and credits. All these methods are as important as the traditional methods and contracts to the protection of enterprises’intellectual properties.Thirdly, empirical studies show strong positive correlation between innovation models of enterprises in internet-based service industry and their IP protection methods, as enterprises will select different IP methods based on the nature of enterprise, the intensity of elements and innovation models. Results show, in general, enterprises with online direct-marketing models prefer to select technical protection and contracts as methods to protect their intellectual properties, while enterprises adopting integrated innovation models and retailer-agent innovation models are lean to copyright, documentation and job rotation as IP protection methods.Finally, comparison of policies in different countries reveals that there are still large gaps between China and developed countries, taking US, Japan for example, in the field of internet-based service innovation and innovation protection. China need take multiple measurements to enhance internet-based service innovation and the development of internet-based service industry, such as improving relevant laws and regulations, strengthening guiding functions of relevant plans, establishing industry ethics and industry self-regulations, improving the quality of internet talents, perfecting IP protection systems and so on.
