Research On Policy System Of Intellectual Property Rights Construction For China’s SMEs

At current,“intellectual property right has become a focus of the international economicand business competitiveness”(Wen-Jiabao), and become a core strategic resources for Chinato improve the capability of independent innovation and build an innovative country;Corporate intellectual property rights relate to the country’s long-term interests and even thesuccess or failure of state construction, which is the entry point for tackling China’s economicdevelopment puzzle.From a global perspective, independent innovation is late-developed countries’(mainlythe innovative countries) fundamental driving force of development by leaps and bounds. Acountry’s capacity for independent innovation depends on the state of construction ofenterprise intellectual property, which includes intellectual property creation, use, protectionand management. China’s actual situation is that many small and medium-sized enterprises(SMEs) are still in a state of “manufacturing” but “no creating”, which makes intellectualproperty issues very prominent, thus severely prevent the independent innovation and healthydevelopment of SMEs.To solve the above problems, the SMEs themselves need to “hard skills”. In addition, astrong involvement from the government is also required. It is an urgent need to formulateand issue a policy system targeted intellectual property rights (construction), which canchange the passive situation of SMEs effectively and enhance the capability of independentinnovation and competitiveness, and promote the sound and rapid development of the nationaleconomy.Therefore, the author attempts to propose the policy framework to promote the buildingof SMEs in China through the study of the related issues of intellectual property system ofSMEs, expecting it can provide decision-making reference for related state departments andfor academic theory research.The main part of this essay is constituted by the six chapters:The first chapter relates to the meaning and basic theory to promote the construction ofthe intellectual property rights of SMEs in China. This part defines the concept of theconstruction of Intellectual Property Rights of SMEs, and analyses the significance and thebasic theory to promote the construction of intellectual property rights of SMEs in China.The second chapter relates to the background, main problems and their causes in theprocess of the construction of the intellectual property rights of SMEs in China. This partanalyzes the background of Law and large-scale enterprises, the main problems and theircauses in the construction of intellectual property rights of SMEs in China. The third chapter relates to typical national experience and its implications of theconstruction of the intellectual property rights of the SMEs. Through analysing theconstruction experience of the intellectual property rights of four typical national SMEsUnited States, Japan, South Korea and India, this chapter analyses their references to ourcountry.The fourth chapter relates to the conception of Intellectual Property Rights PolicySystem of SMEs and the policy evolution and problems of China. First, by defining theconcept of intellectual property rights policy system for SMEs. Then, analysing IntellectualProperty Rights Policy of SMEs and the policy evolution and problems of China.The fifth chapter analyses the characters and demands and the reference of China’sIntellectual Property Rights Policy System for SMEs, analyses the characters of PolicySystem and demands of policy, and introduces the intellectual property policy experience ofthe United States, Japan, South Korea, India. In the end, the reference to the intellectualproperty policy of SMEs in China is concluded.The sixth chapter relates to the constructing principles and framework of intellectualproperty policy system for SMEs in China. This chapter expounds on the basis of constructingprinciples of intellectual property policy system for SMEs, finally proposes the “five-in-one”building framework and measures for promoting the construction of intellectual propertyrights policy system of SMEs in China.
