Research On The Trans-boundary Water Right Conflict And Coordination In The Basins Of China

In recent years,the trans-boundary water rights conflict is becoming increasingly prominent in our country.The administrative regions where rivers flow along exist contradictions and conflicts in the quantity and quality of water.The phenomena that upstream pollution victims downstream and the use of upstream water leads to the exhaustion of downstream water occur frequently.Serious trans-boundary water rights conflict not only effects the construction of environmental friendly society in China,but also easily causes confrontational relationship between upstream and downstream as well as panic among the residents which will threaten social security and stability.As a result,it has become the key problem that needs to be addressed urgently.Currently,though depending on emergency mechanism only can make conflicts be temporarily relieved,in the long run,a set of effective prevention and mediation mechanism for trans-boundary water rights conflict needs to be established.Firstly,this paper sets forth the necessity and feasibility of the trans-boundary water rights conflict coordination mechanism by analyzing its economics theoretical foundation such as Coase theorem,externalities theory and public goods theory.In addition,this paper analyzes the practical background of the conflict from natural background,industry structure,public opinion comments,conflict coordination mechanism and so on by using network public opinion technology.Secondly,under the current non-market mechanism,the prisoner's dilemma game model is applied to analyze the conflict between the upper and lower reaches of the basin which is triggered by self-interest and evolutionary game model is also applied to study two groups-water-rich and water-deficient group which can achieve a long-term equilibrium state by adopting motivation as well as constraint measures such as new trading mechanism and comprehensive legal and administrative system under the condition of multi-agent system.Consequently,it is fully demonstrated that building a comprehensive economic,legal and administrative coordination mechanism is necessary.Thirdly,different from the traditional qualitative analysis and pure theoretical research,by using utility function maximize theory,the conclusion that tradable water rights system can help realize the total revenue maximization and better optimization configuration of the basin water resources have been drawn.Thus it can be seen that,based on science argument,it is of great necessity to build a basin water right trading market.What's more,econometric method is used to show how the laws and administrative policies affect the pollution reduction in the entire trans-boundary basin.And in this process,it is concluded that legal and administrative policies can obviously inhabit industrial wastewater discharge in the areas where river flows by.Finally,drawing lessons from the experience of the United States,Australia and other countries about how they manage the water resources of the basin,this paper brings forward some political suggestions on coordinating water rights conflict of our country from five perspectives:clarifying water rights,building water rights platform,strengthening administrative sanctions,implementing class-action lawsuit system and innovation of administrative law enforcement system.This study characterized:first of all,on transboundary river basin water rights for the first-time economic theoretical basis for a more comprehensive explanation of the conflict,designed to coordinate transboundary basin water rights conflict in China's economic,legal,administrative and coordination mechanisms.Then,the method which supervises the water rights conflict and analyzes the realistic background of this conflict by using network public opinion Technology can have an accurate grasp on the problem of the current coordination mechanism on the trans-boundary water rights conflict.Next,the paper not only uses evolutionary game model which is less made use of at present stage to study the coordination mechanism of water rights conflict in the trans-boundary river basin,but also calculates the shadow price of water rights initial allocation which can be consulted to show the real value of the water resources by applying function maximize theory.Finally,using an econometric approach,for the first time this paper quantitatively analyzes the relationship between law and the Administrative coordination policy and the behavior of water rights.And its research result is of great value for perfecting the administrative coordination system of trans-boundary basin water rights conflict.This study found that there generally existed two kinds of transboundary river conflicts-water quality and quantity,which can easily lead to online public opinion and affect social stability.Therefore,emergency mechanism should be adopted to deal with the conflict of water rights at present.Since China has not yet established a sound economic,administrative,legal basin water rights coordination mechanism,the government should develop a coordinate mechanism based on incentive and constraint to constrain and guide the behaviors of the water rights,and then promote optimized allocation of water resources in trans-boundary basin.
