Research On Evaluation System Of Society With Rule Of Law

The evaluation of the rule of law is regarded as "quantifiable justice".Since the beginning of this century,in order to conform to the international trend,based on the idea of "promoting the construction of evaluation",we have begun to explore the evaluation of rule of law all over China.At the end of 2012,Xi Jinping first proposed the formulation of integrative construction of country,government and society with rule of law in public;and at the end of 2014,the CPC Central Committee issued a document on explaining a number of major issues in the process of ruling the country by law,clearing the specific implementation of the construction of society with rule of law.As a new proposition,the evaluation of society with rule of law has attracted wide attention from all walks of life.Constructing the evaluation system of society with rule of law is the inner requirement of the evaluation of society with rule of law,around the logical thinking of "why to evaluate?who to evaluate?to evaluate who?to evaluate what?how to evaluate" in academic circles.From the viewpoint of evaluation theory,the evaluation of society with rule of law involving law,management,politics and technology,as well as theory,technology and demonstration three aspects,belongs to interdisciplinary and multi-dimensional field.Based on the discipline integration concept,drawing lessons from domestic and foreign experience,combined with normative and quantitative research methods,this paper focuses on the two important issues of constructing evaluation system of society with rule of law: one is the evaluation subject,the other is index system.Because in some sense,the evaluation subjects determine the credibility of the evaluation and the index system determines the scientific nature of the evaluation.After that,the evaluation system is applied to the demonstration of Guangdong Province to get the annual index of "rule of law" in Guangdong,which is aim to evaluate the level,affirm achievements,find problems and put forward some suggestions for improvement.The main conclusions of this study are as follows.Firstly,the evaluation of society with rule of law is an objective requirement of all-round legal country-administration,so promoting the construction of evaluation is in line with the principles of science.In recent years,the evaluation of rule of law in mainland China mainly direct against the research on government ruled by law,belongs to the objective evaluation within the system.Secondly,based on the attribute and value of the rule of law,using the third party as the evaluation subject,this paper constructs a scientific and realistic index system of four basic dimensions of the evaluation of society with rule of law including scientific legislation,law-base administration,judicial justice and law abidance by all the people,composed of 15 objective indexes,8 expert appraisal indexes and 13 public satisfaction indexes.Finally,empirical research on evaluation of society with rule of law in year 2015 of Guangdong province using the evaluation system shows that the annual index is 75.23,and the gaps between 21 above prefecture-level and prefecture-level cities are obvious,indicating that the construction of rule of law in Guangdong has a good foundation,but still having a clear distance from social expectations.The creative achievements of the paper are as follows.Firstly,the paper focus on society with rule of law,moving on to fresh field,fusing multiple research methods.Secondly,this paper creates the evaluation index system of society with rule of law from the perspective of third-party evaluation subject,making efforts to fill the research gaps.Thirdly,the empirical study was carried out in Guangdong province,getting the legality society indexes of year 2015 to test the feasibility of evaluation system,and also provide quantitative basis for promoting the construction of society with rule of law.Of course,as an exploratory empirical study,the evaluation of society with rule of law involves the complex concept and technical problems,such as function orientation,the matching relationship between the subject and the subjective and objective indexes.This paper has discussed but not thorough especially on the data processing of objective index,which is too idealistic,so it is also the direction of future research.
