Construction Of Law-based Government Index System In China-from Prospective Of Governmental Assessment And Observation In Legality Index

With the progress of economical globalization social democracy,the concept of rule of law and its value have been widely recognized throughout the world.As common concentration at present,the international community and countries need to evaluate its developing level and promotion of the rule of law.Instead of the definition of the rule of the law,index assessment of the rule of law is an international trend.While a law-based government become the core content of the construction of the rule of law,the establishment of a scientific assessment index system of the rule of law has become a major task of building a government ruled by law.Performing in-depth theoretical analysis and empirical analysis on on Law-based government's evaluating index system is helpful for further clarify the value connotation of modern government by law,and it has important theoretical and practical significance for the construction of the law-based government.Based on the analysis of the concept of the law-based government and the conception of legality index,this paper makes an in-depth analysis of the connotation of the rule of law and the construction of the assessment index system of the rule of law.It summarizes the present situation and practice of the legal system of the law-based government in China.Based on the aspects of assessment target,subject,object,content and other indicators,this paper elaborately analyze the characteristics,advantages and limitations of the law-based government index system of Hongkong's legality index,Yuhang of Zhejiang Province and law-based government construction index system settled by China University of Political Science and Law as a neutral third party.In reference to the international influential world bank governance index(WGI)and the world justice project(WJP)based on the law-based government assessment index design experience,in-depth analysis of the current China practice assessment of government by law problems in the design of index.Based on reflecting of our assessment index system of law-based government,and China's current lacking of top-level designing of law-based government,lacking of unified assessment standard,this paper puts forward to construct a national applicable,high credibility and multilevel law-based government assessment index system in principle of scientific and practical,openly and diversifying.Based on the introduction of the third party'sassessment,this paper establishes a scientific,dynamic and diversified index system to meet the needs of the construction of the law-based government in our country.
