Land use is an overall and strategic issue during the process of promoting urbanization and co-ordinate development of the urban and rural areas in China. Any country in any period took the land use issues as the basis and researches it carefully, and established relatively clear rules and the implementation of safeguard measures, which included land use, land property rights, land transaction and so on, and constitute the main contents of land use control. Urban-rural dual structure management system had been implementated for a long time in China. In urban-rural dual economic and social organization, the urban-rural dual land system played a decisive role. The long-term stable urban-rural dual land system, in a certain extent, protected the stability of the relationship between urban and rural areas. But it had also formed a multi dual land regulation structure, including land use regulation, property right regulation and transaction regulation. With the development of market economy, the stability of the relationship between urban and rural areas had gradually been broken.The massive destruction of farmland prompted the central government to introduce an increasingly stringent farmland protection system. The farmers'awareness to defend had been growing, but at the same time, they began to obtain income through legal channels.But it is necessary to point out that, with the development of economy, society and the deepening of the land use, though land use regulation institution has been adjusted and perfected, but it was established on urban-rural dual structure management system and two kinds of land ownership. Because of being originated from the city industry and commerce under the leading of the one-way driven, land use regulation system has obvious difference and bias. With the development of urbanization and co-ordinate development of the urban and rural areas being promoted to a deeper level, the rural land demandind on the land property and land property transaction gradually revealed in practice, but all of those are in the lack of legal basis. In addition, co-ordinate development of the urban and rural areas needs urban and rural unified land planning system. The land use regulation system in urban-rural dual structure management system has become the main obstacle to restrict co-ordinate development of the urban and rural areas. As early as 1992, Shenzhen began to explore ways to accelerate the development of urban and rural integration through integrating land ownership and other ways. 1993, Shenzhen implemented a unified planning, unified requisition, unified development, unified development, unified management of the state-owned and collective land use. It was consistent with the current development of new urbanization and co-ordinate development of the urban and rural areas in our country.Based on the background above, the paper argued that land regulation under the background of co-ordinate development of the urban and rural areas was a systematic research field. The paper integrated literature research, empirical analysis and other methods, further absorbed related subjects research content. North (2005)'s institutional analysis framework and Nee (2005)'s institutional selection analysis framework was used to build logical analysis framework of the paper. The logical framework emphasizes the influence of institutional environment and individual (institutional participants) on the change of land regulation system and the path of land regulation system.Under the influence of the system environment and individual, the system changes in different time and space often showed different camera combination mode. Based on the analysis framework above, the paper firstly comprehensively reviewed the domestic and foreign related research progress, reviewed the theoretical basis for land regulation under the background of co-ordinate development of the urban and rural areas.The main issues discussed in this paper including:(1) the necessity of the land regulation.(2) problems and essential reasons of current land regulation.(3) land regulation requirements of the co-ordinate development of the urban and rural areas.The full paper was divided into eight chapters, which mainly included three parts as follows:The first part is research foundation and theoretical framework, including the first chaptera and the second chapter. The first chapter is introduction, which introduced the research background, research progress of land use regulation method and regulation innovation, the content, research methods, possible innovation and shortage, and so on. The second chapter firstly analyzed the theoretical basis of the land use regulation under the background of rural-urban synergy, including the externality theory, regulation theory,system theory, man-land relationship theory and institutional evolution theory.The purpose of this chapter is to overall explanation, draw out the research theme, and form the overall research framework. The theories above and preliminary analysis of the relationship between the theories and land use regulation constituted the theoretical basis of this study.The third section of this chapter put forward the theoretical framework of this research,which aimed to carry out the overall description and leaded to the research topic.The second part is the realistic basis of the study, including the third chapter, the fourth chapter and the fifth chapter. In the third chapter, it proposed the land use regulation evolution process under the system environment of urban-rural dual structure management system in China, including the initial establishment, exploration and development, adiust and reconstruction development.It generally showed gradually demanding induced institutional change characteristics. Subsequently, the paper studied the current system of land regulation in China, and pointed out that it had the characteristics of multiple dual structure management.At the last part of this chapter, it thought that there were some obvious defects in the current land regulation system. In the fourth chapter, it proposed land regulation path under the background of co-ordinate development of the urban and rural areas and requirements for land regulation innovation,combining the dynamic mechanism of the evolution of the relationship between urban and rural areas. It also studied the institutional environment of the land regulation system arrangement and structure optimization in this chapter. The fifth chapter mainly studied land use regulation innovation practice under the background of the co-ordinate development of the urban and rural areas in Shenzhen, and empirically studied land use regulation in the process of co-ordination development of the whole village in H village and industrial land into the city in Fenghuang village of Fuyong town. Research showed that,the evolution of the land regulation system in Shenzhen is characterized by the gradual compulsory institutional change. It took land property rights reform as a breakthrough to gradually promote the whole advancement.The third part is the core part of this paper, including the sixth chapter, seventh chapter and eighth chapter. The sixth chapterstudied the path and implementation requirements of land use regulation under the background of rural-urban synergy. It suggested that land use regulation under the background of co-ordinate development of the urban and rural areas originated from the co-ordinate development of the urban and rural areas reform strategy,which included the land system reform. So the paper designedland use regulation around of economic, social, resources implementation target, and put forward to the important factorand implementation requirements of land use regulation. Furtherly, land use regulation framework meeting co-ordinate development of the urban and rural areas was built. On this basis, the paper built land use regulation model and operating mechanism under the background of rural-urban synergy, including regulation logic, structure model,the relationships among the factors etc.; The seventh chapter studied security of land use regulation under the background of co-ordinate development of the urban and rural areas.The eighth chapter was conclusion and prospect. The main contents of this paper were summarized, and put forward to the research direction and focus in the future.Overall, the paper may be innovative in the following aspects:(1)The framework of institutional analysis of Nee (2005) and North (2005) was used as a theoretical framework in the analysis of land regulation system change in thepaper.According to the logical analysis, the system environment and individual played a key role in the process of institutional change, which affected the depth, direction and performance of institutional change.(2)The paper constructed land regulation system under the background of co-ordinate development of the urban and rural areas.The system should be integrated with the system environment, considering the coordination and integration of property right regulation, land use regulation and transaction regulation. We should establish cooperative land regulation mode, and introduced the land development rights to achieve the overall control objectives.In the implementation of land use regulation measures, we should dilute land ownership structure differences, and take the land function as the starting point.
